1962-0197RESOLUTION NO. 62R -197 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING TE T TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of, the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61 -62 -6- to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from arsons interested therein and from its staff; and WHEREAS, within a period of forty days folowing said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a. summary of the evi- dence presented at said hearing and a recommendation_ that the proposed amendment be adopted by the. City Council and that ce tain.zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City PI r►- ning Commission, the City Council did fix the 27th day of February 19 62 as the time, and the, 777 Council hams bers in the City Hain the City of Anaheim as the place for a public, hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at :.aid public hearing before the Planning Commission, its report of Indings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that T:_Ie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des cribed property, situated in the. City of Anaheim, County of Orange, State of California, to wit: 61- 62 -6L. Lot No. 105 of Tract No. 1453, as shown on a map recorded in Book V, Pages 41 and 4 of Miscellaneous Maps, Records of Orange County, California. be excluded from R -1, ONE FAMILY RESIDENTIAL, ZONE and incor- porated in C -1, NEIGHBORHOOD COMMERCIAL, ZONE upon the following conditions: 1. That the existing residential structures on sub- ject property shall either be removed or developed to commercial standards of existing buildings, and in the latter case, final building or remodeling plans, including elevation plans, shall be sub- mitted to and approved by the City Council. 2. That a landscaped strip of a minimum width of 6 feet shall be provided and maintained abutting the front property line of subject property; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 3. That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of a 6 -foot masonry wall, when required by the City Engineer, along the southerly boundary of subject property where said property abuts R -1, One- Family Residential, Zone property, and that the term of said bond shall be two years from date hereof. 4. That a 50 -foot minimum building setback, from the westerly boundary of the alley at the rear of subject property, shall be established and maintained for any two -story construction; and that no windows shall be installed in the rear of the second story of any two -story structures. 5. That plans for any signs proposed to be installed on subject property, other than unlighted signs having a maximum area of eight square feet, shall be submitted to the City Council for approval. 6. That the uses of subject property shall be limited to business and professional offices only; and that the owners of subject property shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of subject property to business and pro- fessional offices only. 7. That off street parking facilities shall be pro- vided as required by the Anaheim Municipal Code, prior to final building inspection. 8. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Harbor Boulevard for street widening purposes. -2- 9. That any residential structures now located on subject property shall not be used for commercial nor combined residential and commercial use unless remodeled to commercial standards. 10. That the owners of subject property shall deed to the City of Anaheim a strip of land seven feet in width at the rear of subject property for alley widening purposes (It is the inten- tion of the City Council to establish one -way traffic on this alley until such time as necessary dedication is acquired for widening.); but that said dedicationi require- ment shall be temporarily waived until demanded by the City of Anaheim. 11. That the owners of subject property shall dedicate to the City of Anaheim all vehicular access rights to Harbor Boulevard. 12. That the owners of subject property shall: (a) Improve the alley at the rear of subject property to commercial standards, as required by the City Engineer and in accordance with standard plans and speci- fications on file in the Office of the City Engineer, or (b) Deposit with the City of Anaheim, in lawful money of the United States or in negotiable securities endorsed payable to the City of Anaheim, the amount estimated by the City Engineer to cover the cost of improving said alley; PROVIDED, however, that the improvement or amount necessary to improve that portion to be widened shall be waived until demanded by the City of Anaheim. 13. That Conditions Nos. 3, 6, 8, and 11, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper. AND BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, directed to cause a certified copy of this resolution to be recorded in the Office of the County Recorder of Orange County, California.
