A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION NO. 62R -32 IN
RECLASSIFICATION PROCEEDINGS NO. 61- 62 -L6.
WHEREAS, the City Council did heretofore, to wit, on
January 16, 1962, adopt Resolution No. 62R -32 in Reclassification
Proceedings No. 61- 62 -tj6, finding and determining that the prop-
erty and area therein described should be changed from R -1, One
Family Residential Zone to C -1, Neighborhood Commercial Zone,
subject to certain conditions set forth therein, numbered 1 to
12, both inclusive; and
WHEREAS, it was the intent of the City Council that the
conditions hereinafter set forth should also be included in said
resolution as conditions upon which said property will be reclass-
ified, but the City Council finds that through inadvertence or
oversight said conditions were omitted from Resolution No. 62R -32;
and
WHEREAS, it was also the intent of the City Council
that as and when the owner or owners of any of the lots described
in said resolution have complied with all of the conditions
applicable to such lot or lots, an ordinance rezoning such lot
or lots might be adopted, but the City Council further finds
that through oversight this provision was also omitted from
Resolution No. 62R -32; and
WHEREAS, the City Council does find that said Resolution
No. 62R -32 should be amended by incorporating therein the conditions
hereinafter mentioned and a provision to the effect that when
the owner or owners of any of the lots described therein have
complied with all of the conditions applicable to such lot or lots
an ordinance rezoning such lot or lots may be adopted; and
WHEREAS, the City Council does further find that an
ordinance has never been adopted directing said change of zone
and completing said reclassification proceedings.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution No. 62R -32 in Reclassification
Proceedings No. 61 -62 -L6 be, and the same is hereby, amended by
adding thereto the following conditions, which shall be numbered
13 to 15, both inclusive:
"13, That the owners of the property shall dedicate
to the City of Anaheim all vehicular access
rights to Harbor Boulevard.
1. That the owners of the property shall deed to
the City of Anaheim a strip of land 7 feet in
width along the rear or east side of subject
property for alley widening purposes.
15. That the owners of the property shall:
(a) Improve the alley along the rear or east
side of subject property to commercial
standards as required by the City Engineer,
and in accordance with standard plans and
specifications on file in the Office of the City
Engineer, or--

(b) Deposit with the City of Anaheim, in
lawful money of the United States or
in negotiable securities endorsed
payable to the City of Anaheim, the
amount estimated by the City Engineer
to cover the cost of improving said
a1ley.
BE IT FURTHER RESOLVED that Condition No. 12 of said
Resolution No. .62R- 32,be, and the same is hereby, amended to
include Conditions Nos. 13, 14 and. 15 {b).
BE IT FURTHER RESOLVED that the following provision
be incorporated in Resolution No. 62R
"That the City Attorney be, and he is hereby, authorized
and directed to prepare and submit to the City Council
an ordinance rezoning any of the above described lots
when all of the conditions applicable to such lot or lots
have been met and complied with.
AND BE IT FURTHER that in all other respects
Resolution No, 62R -32 be and remain in full force and effect.
THE FOREGOING RESOLUTION is approved and signed by me
this 27th day of,February, 1962.
