A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM TEMPORARILY WAIVING THE
CONDITIONS OF DEDICATION AND IMPROVEMENT
OF THE ALLEY RIGHT -OF -WAY AS FORTH
IN RESOLUTION NO. 62R -33.
WHEREAS, Resolution No. 62R -33 adopted by the City
Council on January-16, 1962 in Reclassification Proceedings
No. 61= 62 -I 9 requires the owners of the Yieretnafter 'described
property to to the City of Anaheim a strip of land
7 feet in width along the rear of said property for 'alley
widening purposes and to improve sald alley to commercial
standards as required by the City Engineer and in accordance
with standard plans and specifications on file in the Office
of the City Engineer; and
WHEREAS, the City Council does find and determine
that there is no present need for such dedication and improve-
ment of said 7-foot strip and that a temporary waiver of
these requirements should be granted until such time as said
dedication of right of way for alley purposes and the improve-
ment thereof are found to be necessary and required by the
City Engineer.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that a temporary waiver of the condi-
tions of Resolution No. 62R -33 requiring the owners of the
following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
Lot 100 of Tract No. 1453, as shown on a
map recorded in Book 42, Pages 41 and 42
of Miscellaneous Maps, records of Orange
County, California.
to deed to the City of Anaheim a strip of land 7 feet in
width along the rear of said property for alley widening
purposes and to improve said 7 -foot strip to commercial
standards as required by the City Engineer and in accord-
ance with standard plans and specifications on file in the
Office of the City Engineer, be, and the same is hereby,
granted until such time as said dedication and improvement
shall be deemed necessary and required by the City Engineer.
BE IT FURTHER RESOLVED that this temporary waiver
of dedication and the obligation of the owners to improve
said 7 -foot strip when requested shall be, and is hereby
declared to be, a covenant running with the land and shall
be binding upon the heirs, successors, and assigns of the
present owner or owners.
AND BE IT FURTHER RESOLVED that the City Clerk be,
and she is hereby authorized and directed to cause a certified
copy of this resolution to be placed of record in the Office
of the County Recorder of Orange County, California.
THE FOREGOING RESOLUTION is approved and signed by
