1962-0111RESOLUTION NO. 62R -111 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUISITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL PURPOSES. WHEREAS, JOSE CISNEROS, aka JOSE Z. CISNEROS, and AUGUSTINA M. CISNEROS, aka AUGUSTINA CISNEROS, husband and wife, Finance Dir R/W are the owners o t e ere na ter described real property situated in the City of Anaheim, County of Orange, State of California,; and WHEREAS, said owners have offered to sell said property to the City of Anaheim for the sum of $8,500.00 cash, lawful money of the United States; and WHEREAS, the City Council does find and determine that public convenience and necessity require the purchase and acquisition of said real property for municipal purposes, and that the price which the owners thereof are willing to accept is reasonable and not out of proportion to the fair market value of said property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of JOSE CISNEROS aka JOSE Z. CISNEROS, and AUGUSTIINA M. CISNEROS, a a 4 1 1 Ir 1 *OS, husband and W1] to s e l l to the City of Anaheim all that real property situated in.. the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1: That portion of Lot A of Tract No. 97, as per map recorded in Book 11 Page 39 of Miscellaneous Maps, described as follows: Beginning at a point in the westerly line of said Lot A, distant thereon 275 feet southerly from the northwest corner of said lot, and running thence southerly along the westerly line of said lot 40 feet; thence easterly, parallel with the northerly line of said lot, 100 feet; thence northerly, parallel with the westerly line of said lot, 40 feet; thence westerly parallel with the northerly line of said lot, 100 feet to the point of beginning. PARCEL 2: That portion of Lot A of Tract No. 97, as per map recorded in Book 11, Page 39 of Miscellaneous Maps, described as follows: Commencing on the easterly line of Parry Avenue at a point 355 feet from the northwest corner of said Tract No. 97; thence East 100 feet, parallel to the North line of Tract No. 97, to the true point of beginning; thence North 80 feet, parallel with the east line of Parry Avenue; thence East 35.4 feet, parallel with the north line of said Tract No. 97; thence South 80 feet to a point which is 3541 feet East of the true point of beginning; thence West 35.1111 feet, parallel with the North line of said Tract No. 97, to the true point of beginning. -1- ATTEST: for the sum of $8,500.00 cash, lawful money of the United States, be, and tie same is he`rreby, accepted subject to the following terms and conditions: Attorney. 2. That the Sellers shall pay that portion of the second half of the taxes for the fiscal year 1961-62 on subject property from Januay 1, 1962, to date the deed to the City of Anaheim is recorded. BE IT FURTHER RESOLVED that the City Managed and the City Attorney of the City of Anaheim be, and either -of them is hereby, authorized for and on behalf of the City of Anaheim to sign escrow y instructions for the purchase of said real prop ert and to enter into: an escrow withâ–º the owne -rs of said property at United California Bank, Anaheim Office, Anaheim, Ca1 iforn ia. AND BE IT FURTHER RESOLVED that the City Auditor be, and he is hereby, authorized to deposit in escrow at said United California Bank $8,500.00 cash, lawful money of the United States, to be paid to the owners of said real property when a deed conveying said property to the City of Anaheim free and clear of all encumbrances, except as hereinabove set forth, can be recorded and a policy of title insurance issued by Title Insurance and Trust Company, 800 North Main, Santa Ana, California, showing said property vested in the City of Anaheim as hereinabove specified. AND BE IT FURTHER RESOLVED that the Buyer shall pay all escrow fees in the purchase of said property, including the charges for furnishing a policy of title insurance necessary to show title vested in the City of Anaheim, the U. S. Internal Revenue stamps required to be affixed to the deed, etc. THE FOREGOING RESOLUTION is approved and signed by me this 13th day of February 19 62 1. WILLIAMS, City Clerk of the City of Anaheim, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting provided by law, of the City Council of the City of Anaheim, held on the 13th day of February, 1962, by the following vote of the members thereof: AYES: COUNCILMEN: Chandler, Coons, Fry and Thompson.
