1962-0110RESOLUTION NO. 62R 110 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUISITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL PURPOSES. WHEREAS, THOMAS TORRES and ESPERANZA A. TORRES also known as ESPERANZA TORRES, husband and wife, are the owners o the ere naf er described real property situated in the City of Anaheim, County of Orange, State of California,; and WHEREAS, said owners have offered to sell said property to the City of Anaheim for the. sum of j14,900.00 cash, lawful money of the United States; and WHEREAS, the City Council does find and determine that public convenience and necessity require the purchase and acquisition of said real property for municipal purposes, and that the price which the owners thereof are willing to accept is reasonable and not out of proportion to the fair market value of said property. Torres also known as Esperanza Torres husband and wife. o se to t e ty of Anaheim all that real property situated in. the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL I: That portion of Lot A of Tract No. 97, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 11 Page 39 of Miscellaneous Maps, in the Office of the County Recorder of said County, described as follows: Beginning at a point on the North line of said Lot A, 124.53 feet East of the Northwest corner thereof, thence South parallel to the West line of said Lot A to the Northeast corner of the Parcel of land conveyed to Frank Lee by deed recorded November 4, 1925 in Book 614 Page Deeds, records of said Orange County; thence continuing South along the East line of said land so conveyed to Lee, to the Northwest corner of the parcel of land conveyed to Antonio E, Sandoval, et ux., by deed recorded June 21, 1926 in Book 6 55 Page 359,Deeds, records of said Orange County; thence East along the North line of said last mentioned land, 41.51 feet; thence North parallel to the West line of said Lot A, 50 feet to a point in the North line of said Lot, 41.51 feet East of the point of beginning; thence Westerly 41.51 feet to the point of beginning. PARCEL II: That portion of Lot A of Tract No. 97, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 11, Page 39 of Miscellaneous Maps, in the Office of the County Recorder of said County, described as follows: Beginning at a point on the West line of said Lot A, 35 feet South of the Northwest corner of said Lot A; thence continuing South 40 feet along said West line; thence East 124.53 feet parallel with the North line of said Lot A; thence North 40 feet parallel with the West line of said Lot A; thence West 124.53 feet parallel with the North line of said Lot A; to the point of beginning. for the sum of _114_ 1 900.00 cash, lawful money of the United States, be, and t e same =Fay, y, accepted subject to the following terms and conditions: 1. That said property shall be conveyed to the City of Anaheim free and clear of all en- cumbrances except the second half of all general and special taxes for the fiscal year 1961 -62, including any special district levies, payment of which is included therein and collected therewith; all taxes and assessments levied or assessed subsequent to the date the escrow, hereinaf*.er referred to, is entered into between Buyer and Sellers; and all covenants, 'conditio s restrictions, reservations, rights, rights of wayand easements of record approved by The City Attorney. 2. That the Sellers shall pay that portion of the second half of the taxes for the fiscal year 1961 -62 on subject property from January 1, 1962, to date the deed to the City. of Anaheim is recorded. BE IT FURTHER RESOLVED that the City Manager and the Cit y Attorne y of the City of Anaheim be, and either of them is hereby, authorized for and on behalf of the City of Anaheim to sign escrow instructions of said real prop tions for the purchase o erty and to enter into an escrow with the owners of said property at United California Bank, Anaheim Office, Anaheim, California. AND BE IT FURTHER RESOLVED that the City Auditor be, and he is hereby, authorized to deposit in escrow at said United California Bank $1)1 goo OO cash, lawful money of the United States, to be paid to tie owners of said real property when a deed conveying said property to the City of Anaheim free and clear of all encumbrances, except as hereinabove set forth, can be recorded and a policy of title insurance issued by Title Insurance and Trust Company, 800 North Main, Santa Ana, California, showing said property vested in the City of Anaheim as hereinabove specified. AND BE IT FURTHER RESOLVED that the Buyer shall pay all escrow fees in the purchase of said property', including the charges for furnishing a policy of title insurance necessary to show title vested in the City of Anaheim, the U. S. Internal Revenue stamps required to be affixed to the deed, etc. (Costs of reconveyance to be paid by Sellers.)
