1962-0102RESOLUTION NO. 62R -102 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING TILT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61- 62 -66 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from p:rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the.City Council and that :er- taro zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 6th day of February 19 62 as the time, and the Council ham= bers in the City Hall in the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it Is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal. Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its repo; t of f`ndings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code shouid be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that T_le 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to. wit: -1- 61 -62 -66 The West 5 acres of the North 18 acres of the East 30 acres of the Northeast quarter of the Northwest quarter of Sec- tion 13, Township 4 South, Range 11 West, S.B.B. M. EXCEPTING THEREFROM the North 66 feet. Also EXCEPTING THEREFROM that portion of said land conveyed to the Orange County Flood Control District by deed recorded June 20, 1960 in Book 5293, page 146 of Official Records. be excluded from the R--A, RESIDENTIAL- AGRICULTURAL ZONE, and incorporated in the following zone or zones; R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibits Nos. 1 and 2," on file with the City of Anaheim, with a.provision that a 35- foot building setback line shall be established and maintained along Lincoln Avenue; and that said building setback area, excepting that portion thereof reserved for access drives or walks, shall be landscaped and said landscaping maintained. 2. That 6 -foot masonry walls, or walls of equiv- alent construction, shall be constructed along the east, south and west boundary lines of subject property. 3. That all engineering requirements of the City of Anaheim, along Lincoln Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guar- antee the installation of said engineering requirements and the construction of said walls mentioned in Condition No. 2 hereof. 4. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Lincoln Avenue for street -2- lighting purposes. 5. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit to be used for park and re- creation purposes, said amount to be paid at the time the building permit is issued. 6. That adequate areas for trash storage, acces- sible to trash truck pickup, shall be provided as required by the Street Maintenance and Sanitation Division of the Public Works Depart- ment, which areas shall be 'enclosed, by a solid fence or wall prior to final building inspection. 7. That the reclassification of subject property under these proceedings is subject to the granting of Conditional Use Permit No. 192. 8. That Conditions Nos. 3(b) and 4, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
