Purpose:
The purpose of this regulation is to establish a policy and procedure for pre -employment
drug screening as part of the pre -employment medical examination for all positions. The
City of Anaheim "City" is committed and responsible for maintaining a drug -free
workplace for the protection and well-being of the City, its employees, and the public in
accordance with the Federal Drug -Free Workplace of 1988. All candidates must
successfully pass a pre -employment drug screening as a condition of employment.
The records of all drug tests and results shall be handled in accordance with all applicable
federal laws and regulations. Disclosure of test results to any other person, agency or
organization is prohibited unless written authorization is obtained from the candidate.
However, the City is not required to obtain written authorization from the candidate
tested when drug testing becomes the subject of a judicial, quasi-judicial or other
administrative proceeding.
Candidates will be informed of the drug screening via job bulletin and as a part of the
selection process.
Procedures:
Once a conditional job offer has been extended, the candidate acknowledges the
following:
1) To give drug screening consent, a candidate is required to sign the Confidential
Medical Information Act Authorization Form (Attachment A).
2) Right to refuse testing with the understanding that passing the drug screening is a
requirement of the position.
3) Substitution/alteration of a drug test sample and/or failed result in a drug
screening will result in the conditional job offer being rescinded.
4) Right to explain a positive test result on a confirmatory test. The candidate has 24
hours to provide a valid medical prescription for the controlled substance
identified in the drug screening.
5) A confirmatory retest may be requested but paid for by the candidate.
6) A candidate with a positive test result will be removed from the eligibility list.

The drug screening will test for illegal drug use and will be conducted in accordance with
the medical provider and laboratory's protocol for administering toxicology tests.
The Department of Transportation (DOT) positions have special requirements for drug
and alcohol testing compliance, refer to AR 280 Alcohol and Controlled Substances
Testing of Employees with Commercial Drivers Licenses.
Responsibility:
Human Resources will administer the drug screening program as a part of the pre-
employment medical examination. Risk Management is responsible for selecting a
reputable and competent medical provider to conduct this screening.
The drug screening results will be retained within the medical examination results in a
secured location in compliance with the Confidentiality of Medical Information Act,
Civil Code Section 56.20 (a).

Disclosure of Confidential Medical Information
Confidentiality of Medical Information Act ("CMIA"), Civil Code §§ 56.20, 56.21.
Pursuant to California's Confidentiality of Medical Information Act, 1,
[Name of Applicant], authorize the City of Anaheim to
receive, use, and disclose my medical information for legitimate, non-discriminatory
business purposes where necessary for the City of Anaheim to make work -related
decisions about reasonable modifications and workplace safety.
Specifically, I authorize the City of Anaheim to receive, use, and disclose this
information for the purposes below:
This authorization is limited to the following types of information:
Pre -employment medical screening information
The City of Anaheim is authorized to use this information for the following
purposes:
Engaging with me in the interactive process, in the hiring process and
upon employment, to identify reasonable accommodations and ensure
the health and safety of me, employees, and the public.
Authorization period:
The parties specified above are authorized to disclose information
regarding my medical information in the manner specified above
through one year from signed and approved date.
Right to receive a copy of this authorization:
I understand that if I sign this authorization, I have the right to receive
a copy of this authorization. Upon request, the City of Anaheim will
provide me with a copy of this authorization.
I authorize the limited uses and disclosures of my medical information as
described above for the purposes listed above. I understand that this
authorization is voluntary and that I am signing this authorization voluntarily.
