1962-0583WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. to consider an amendment to Title 18 of the Anaheim un c pal Co a relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence pre- sented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 1 th� day of June 19 62 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon con- sider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: RESOLUTION NO. 2R 1., A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELA"I1.NG TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. The South one -half of the Southeast quarter of the North- east quarter of the Northeast quarter of Section 27, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, as shown on a map thereof recorded in book 51, page 7 et seq., Miscellaneous Maps, records of said Orange County; -1- 61 -62 -103 EXCEPTING the North half of the following: Beginning at a point on the North line of the Southeast quarter of the Northeast quarter of Section 27, in Township L. South, Range 10 West of said rancho, said point of beginning being 35 feet West of the Northeast corner of the Southeast quarter of the Northeast quarter of said section; thence South parallel to the East line of said section, 10 feet; thence West parallel to the North line of the Southeast quarter of the Northeast quarter of said section, 20 feet; thence North parallel to the East line of said section, 20 feet; thence East parallel to the North line of the Southeast quarter of the Northeast quarter of said section, 20 feet; thence South parallel to the East line of said section, 10 feet to the point of beginning. be excluded from the R -A, RESIDENTIAL AGRICULTURAL ZONE, and incorporated in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That subject property shall be developed substantially in accordance with plans marked "Exhibit No. 1 (Revised)," on file with the City of Anaheim, except as amended herein. 2. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Haster Street for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim, along Haster Street, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. Lk. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Haster Street, for street lighting purposes. 5. That the owners of subject property shall pay to the City of Anaheim the sum of $25,00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 6. That the completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 230. 7. That fire hydrants shall be installed as and when required by the Chief of the Fire Department of the City of Anaheim. 8. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. -2- 9. That the interior walls of the carports proposed to be constructed on subject property shall be completed with stucco; that proper bumper guards shall be installed to protect the interior walls from damage; and that enclosed storage cabinets shall be installed in the carport areas. 10. That landscaping shall be installed and maintained in the parkway portion of the Raster Street right of way; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 11. That subject property shall be developed with a minimum of five different elevations, subjecttt the approval of the Architectural Control Committee; provided, however, that the three buildings fronting on Raster Street shall be constructed with three different elevations. 12. That Conditions Nos. 2, 3(b), and 4 above- mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
