A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE LEASING
OF THE HEREINAFTER DESCRIBED PROPERTY
TO WILLIAM H. MONTAGUE AND FRANCES
ELIZABETH MONTAGUE.
WHEREAS, the City of Anaheim, as purchaser, and
WILLIAM H. MONTAGUE AND FRANCES ELIZABETH MONTAGUE, husband
and wife, as sellers, did heretofore enter into escrow for
the purchase and sale of the hereinafter described property;
and
WHEREAS, as a part of the agreement in connection
with said escrow the City of Anaheim and William H. Montague
and Frances Elizabeth Montague, agreed to enter into a lease
for the leasing of said property to said William H. Montague
and Frances Elizabeth Montague, husband and wife, in accord
ance with the terms hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the City enter into a lease with
William H. Montague and Frances Elizabeth Montague, husband
and wife, for the leasing of the following described property:
That certain real property situated in the
County of Orange, State of California, and
more particularly described as follows:
The Northeast quarter of the Southeast
quarter of the Northwest quarter of
Section 13, Township 4 South, Range 10
West, San Bernardino Base and Meridian.
EXCEPTING the West 11 feet thereof as per
deed recorded July 18, 1961, in book 5787,
page 292 in the Office of the County Re-
corder of said Orange County.
to said William H. Montague and Frances Elizabeth Montague,
husband and wife, upon the following terms and conditions:
1. That said property shall be leased to said
William H. Montague and Frances Elizabeth
Montague, husband and wife, for a term of
three (3) years commencing on the 16th day
of July, 1961 and ending on the 15th day of
July, 1964, at an annual rental of Four
Thousand Five Hundred Dollars ($4,500.00),
lawful money of the United States, payable
as follows: The sum of Four Thousand Five
Hundred Dollars ($14500.00) on or before
July 16, 1962; the sum of Four Thousand
Five Hundred Dollars ($4,500.00) on or before
the 16th day of July, 1963; and the sum of
Four Thousand Five Hundred Dollars ($4,500.00)
on or before the 16th day of July, 19
2. That the lessees may renew said lease for an
additional two -year period upon written notice
of intention so to do given to the City within
three (3) months prior to the end of the term
thereof; provided further that said option
shall be effective only in the event that the
City has no immediate need to develop said property
for public purposes.
3. The lessees may sublet the demised premises
with the consent of the City, provided, however,
any subletting by the lessees shall not relieve
lessees of the obligation for the rental pay-
ments herein set forth.
That the City shall have the right to cancel
said lease on thirty (30) days' written notice
to the lessees, subject, however, to the payment
by the City to the lessees of any out -of- pocket
expenses for the care of the orange grove situ-
ated on said premises from the beginning of the
rental year immediately preceding receipt of
written notice of termination and the date of
said notice.
BE IT FURTHER RESOLVED that the Mayor and City
Clerk be, and they are hereby, authorized to execute a
lease agreement for the leasing of the above- described
property to William H. Montague and Frances Elizabeth
Montague, husband and wife, upon the terms and conditions
hereinabove'mentioned.
THE FOREGOING RESOLUTION is approved and si•ned
by me this 6th day of June, 1962.
