A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DETERMINING THE NECESSITY
FOR, AND DIRECTING THE ACQUISITION, BY
EMINENT DOMAIN, OF REAL PROPERTY FOR
HIGHWAY EASEMENT AND PUBLIC UTILITY
PURPOSES, AND RESCINDING RESOLUTION
NO. 62R-386.
WHEREAS, public convenience and necessity require the
acquisition of certain real property within the City of Anaheim
for the following purposes, to wit: highway easement and public
utility purposes; and
WHEREAS, the City Council does find and determine that
public interest and necessity require the acquisition of all
that certain real property herein described, by the City of
Anaheim for highway easement and public utility purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that public interest and necessity require
the acquisition of that certain real property situated in the
City of Anaheim, County of Orange, State of California, more
particularly described as follows, to wit:
PARCEL 1:
PARCEL 2:
An easement for highway and public utility pur-
poses over, under and across the Northerly 53.00
feet of the following described parcel of land:
The Westerly 2.84 acres of Lot Two (2) and the
Easterly 2.83 acres of Lot Three (3) of Orange
Grove Acres as shown on a Map recorded in Book
6, Page 42 of Miscellaneous Maps, records of
Orange County, California.
An easement for highway and public utility pur-
poses over, under and across a portion of Lot
One(1) of Orange Grove Acres, as shown on a
Map recorded in Book 6, Page 42 of Miscellaneous
Maps, records of Orange County, California, lying
within a strip of land 53.00 feet in width, the
North line of said strip being described as
follows:
Beginning at the Northwest corner of said Lot
One (1), said Northwest corner being the inter-
section of the West line of Lot One and the
center line of La Palma Avenue, 40.00 feet in
width; thence North 73 44' 00" East a distance
of 81.32 feet to the beginning of a tangent curve
concave Northwesterly, having a radius of 1,000
feet; thence Easterly and Northeasterly along said
curve through a central angle of 12 59' 14" an arc
distance of 226.67 feet.

PARCEL 3:
An easement for highway and public utility
purposes over, under and across the following
described parcel of land:
Beginning at the Southeast corner of Lot One of
Fractional Section 5, Township 4 South, Range 9
West, of the San Bernardino Meridian, County of
Orange, State of California, according to an
Official Plat of said land filed in the District
Land Office, March 23, 1875; thence Westerly
along the South line of said Lot One, a distance
of 440.38 feet to the true point of beginning;
thence continuing Westerly along the South line
of said Lot One, a distance of 371.84 feet to
the intersection with the Easterly line of the
right of way of the Atchison, Topeka and Santa
Fe Railroad; thence Northeasterly along the
Easterly line of said Railroad right of way, a
distance of 44.62 feet; thence Southeasterly in
a direct line to the true point of beginning,
EXCEPTING THEREFROM the Southerly 20 feet lying
within the present right of way of La Palma Avenue.
BE IT FURTHER RESOLVED that the City Council does here-
by find and determine that public interest and necessity require
the acquisition of said land by the City of Anaheim for the
aforesaid purposes, and that the taking of the property here
inabove described is necessary therefor, and that the uses to
which it is to be put are uses authorized by law, and the
taking of said property is necessary to such uses.
BE IT FURTHER RESOLVED that the City Council does
hereby authorize the acquisition of said property by the City
of Anaheim, and the City Attorney of the City of Anaheim is
hereby directed to institute an action in eminent domain for
the acquisition of the title to said property, and to perform
and carry out all of the necessary proceedings and steps incident
to the acquisition of the title to said property and to obtain-
ing immediate possession thereof.
BE IT FURTHER RESOLVED that the City Council does
hereby rescind its former Resolution No. 62R -386, dated
April 24, 1962.
THE FOREGOING RESOLUTION is approved and signed by
me this 29th day of May, 1962.
