A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING AND APPROVING THE
EXECUTION OF AN AGREEviENT WITH SOUTHERN PACIFIC
ODNPANY GRANTING TO THE CITY AN EASBUIENT TO
CONSTRUCT AND OPERATE A 30 -INCH WATER PIPE
BENEATH THE PROPERTY AND TRACKS OF SOUTHERN
PACIFIC COMPANY BETWEEN SOUTH ANAHEIM AND
MARLBORO, CROSSING BENEATH THE CENTER LINE OF
SOUTHERN PACIFIC COIF %PANY x S TRACKS AT ENGINEER
STATION 57 +74.
WHEREAS, the Southern Pacific Company, a corporation
of the State of Delaware, has tendered to the City of Anaheim
an Indenture granting to the City of Anaheim subject to the
terms, covenants and conditions therein contained, an easement
to construct, reconstruct, maintain, and operate a 30 -inch
reinforced concrete storm drainage pipe line, beneath the
tracks and property of the Southern Pacific Company between
South Anaheim and Marlboro, in the County of Orange, State of
California, crossing beneath the center line of the Southern
Pacific Companyts tracks at Engineer Station 57 +74, in the
approximate location shown in red on the print of said Com-
panyts Los Angeles Division Drawing A -5414, Sheet•No. 2, revised
April 9, 1962, attached to and made a part of the Indenture
above mentioned; said pipe line to be constructed and maintained
in accordance with the specifications indicated on the print
of Drawing C.S. 1741 of the Southern Pacific Company; and
WHEREAS, said grantor has tendered to the City of
Anaheim the Indenture above mentioned to be executed by said
Southern Pacific Company and the City of Anaheim, which In-
denture the City Council finds would be for the benefit and
best interest of the City of Anaheim and should be approved;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Indenture tendered to the City of
Anaheim by the Southern Pacific Company, a corporation of the
State of Delaware, granting to the City, but subject to the
terms, covenants, and conditions therein contained, an easement
to construct, reconstruct, maintain and operate a 30 -inch re-
inforced concrete storm drainage pipe line beneath the tracks and
property of Southern Pacific Company between South Anaheim and
Marlboro, in the County of Orange, State of California, crossing
beneath the center line of Southern Pacific Companyts tracks at
Engineer Station 57 +74, as hereinabove more particularly described,
be, and the same is hereby, approved and accepted.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said In-
denture, above mentioned, for and on behalf of the City of Anaheim.
