1962-0511RESOLUTION NO. 62R- 511 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING AND APPROVING THE EXECUTION OF AN AGREEMENT WITH SOUTHERN PACIFIC COMPANY, GRANTING TO THE CITY AN EASEMENT TO CONSTRUCT AND :OPERATE A. 63 -INCH PIPE LINE FOR STORM DRAINAGE WATERS BENEATH THE TRACKS AND PROPERTY OF THE SOUTHERN PACIFIC COMPANY BETWEEN ITS STATIONS OF WEST ANAHEIM AND STANTON, COUNTY OF ORANGE, STATE OF CALIFORNIA. ATTEST: fi/ C ERK OF THE CITY OF ANAHEIM Attorney Engr R/W WHEREAS, the Southern Pacific Company, a corporation, has tendered to the City of Anaheim an agreement, granting to the City, subject to the reservations, covenants and conditions therein contained, an easement to construct, reconstruct, main- tain and operate a 63 -inch reinforced concrete pipe line for the conveying of storm drainage waters beneath the tracks and property of Southern Pacific Company between its stations of West Anaheim and Stanton, in the County of Orange, State of California, in the approximate location shown in red on the print of Southern Pacific Company's Los Angeles Division Drawing A- 37)jla_, Sheet No. 2, revised February 8, 1962, attached to and made a part of the agreement above mentioned, said pipe line to be constructed and maintained in accordance with the specifica- tions indicated on the print of said Company's Drawing C.S. 1711 also attached to and made a part of said agreement; and WHEREAS, the said Southern Pacific Company has sub- mitted the above mentioned agreement to the City of Anaheim to be executed by the Southern Pacific Company and the City, which agreement the City Council finds would be for the benefit and best interest of the City of Anaheim and should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the agreement tendered to the City of Anaheim by the Southern Pacific Company, a corporation, granting to the City, but subject to the reservations, covenants, and con- ditions therein contained, an easement to construct, reconstruct, maintain and operate a 63-inch reinforced concrete pipe line for the conveying of storm drainage waters beneath the tracks and property of Southern Pacific Company between the stations of West Anaheim and Stanton, in the County of Orange, State of Cal- ifornia, in the approximate location shown in red on the print of Southern Pacific Company's Los Angeles Division Drawing A- 3744, Sheet No. 2, revised February 8, 1962, attached to and made a part of the agreement above mentioned, said pipe line to be con- structed and maintained in accordance with the specifications indicated on the print of said Southern Pacific Company's Drawing C.S. 1741 also attached to and made a part of said agree- ment, be, and the same is, hereby approved and accepted. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized to execute said agreement above mentioned for and on behalf of the City of Anaheim.
