1962-0427RESOLUTION NO. 62R. -L27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE, ON BEHALF OF THE CITY OF ANAHEIM, AN AGREEMENT BETWEEN THE CITIES OF ANAHEIM, COLTON AND RIVERSIDE, AND H. ZINDER ASSOCIATES RELATING TO A SURVEY OF FUTURE POWER SOURCES. WHEREAS, the Cities of Anaheim, Riverside and Colton wish ;jointly' tp employ H. ZINDER ASSOCIATES, a partnership, to make a power supply study for the areas, served by said Cities; and WHEREAS, H. Zinder Associates has offered to per- form such study for said Cities of Anaheim, Colton and Riverside and has this day submitted to the City Council a form of agree- ment to be made and entered into by and between said Cities and H. Zinder Associates for the performance of such power supply study, the terms and conditions of which the City Council finds to be satisfactory, and that said agreement should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the agreement this day submitted to the City Council entitled, "Consulting Services Agreement between Cities of Anaheim, Riverside and Colton, California, and H. Zinder Associates," to be made and entered into be- tween said Cities and H. Zinder Associates for the employment of said H. Zinder Associates upon the following terms and conditions: Consulting Services 1. That said Zinder Associates will make a study of the electric power supply of said Cities to include the following: (a) Analysis of present and future power require- ments individually and in the aggregate for the three cities. (b) A comparative study of alternative sources of power supply, including: (1) Continuation of present power supply ar- rangements. (2) Power supply by purchase from or by joint arrangement with other agencies or companies. (3) Construction of self -owned generation by Cities. 2. That the study will be preliminary in nature, its purpose being to explore on a broad basis the alternatives available to Cities for a power supply for the foreseeable future. That said Zinder Associates, however, will recommend a course of action with respect to alternative plans for said Cities' power program. -1- Attorney Finance 3. That the study will be completed and report thereon prepared and submitted in draft form to each of the three cities within ninety days after formal approval of said agreement by said Cities. 4. That, after discussion of said draft of study with said Cities, said Zinder Associates will issue a report in final form and will furnish 25 copies thereof to each of the three cities. 5. That as study progresses, said Zinder Associates from time to time will meet with representatives of said Cities to discuss progress of study. 6. That said Cities will provide said Zinder Associates with access to records and data and will permit consultation with personnel of staff on local matters, all as reasonably available and necessary to enable said Zinder Associates to carry forward purposes of study. Compensation Said Cities will reimburse said Zinder Associates in accordance with said Zinder Associatest schedule of Rates and Charges dated 1/1/61, marked "Exhibit A," attached hereto and made a part hereof, provided,however that: 1. The total charges for professional and non professional services shall not exceed $9.000, 2. That said Cities will withhold payment of $2,000 until said Zinder Associates! services, as here inbefore described, have been completed. 3. That billings will be rendered to and payable by said Cities on a pro rata basis as follows: Anaheim 4 per cent Riverside 47 per cent Colton 5 per cent Discharge of Obligation Upon rendering of Report in final form by said Zinder Associates, and upon final payment of compensa- tion by said Cities, all obligations and commitments under said agreement will be terminated. be, and the same is hereby, approved. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby, authorized to execute said agreement for and on behalf of the City of Anaheim.
