RESOLUTION NO. 62R- 415
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING. THE
EXECUTION OF A PIPE LINE LICENSE AGREEMENT
WITH THE ATCHISON, TOPEKA AND SANTA FE RAILWAY
COMPANY GRANTING TO THE CITY A LICENSE TO
CONSTRUCT AND MAINTAIN ONE -PIPE LINE 27" IN
DIAMETER ACROSS OR ALONG THE RIGHT OF WAY OF
SAID RAILWAY COMPANY AT OR NEAR THE STATION
OF ATWOOD, ORANGE COUNTY, CALIFORNIA.
WHEREAS, the Atchison, Topeka and Santa Fe Railway
Company, a`Kansas corporation, has tendered to the City of
Anaheim a license agreement dated April 20, 1962, licensing
the City of Anaheim to construct, maintain and use solely for
carrying sewage effluent, one pipe line 27" in diameter across
or along the right of way of the Atchison, Topeka and Santa Fe
Railway Company at or near the station of Atwood, Orange County,
California, subject to the terms, covenants and conditions con-
tained in said agreement, the exact location of said pipe line
being more particularly shown by red coloring upon said Railway
Companyts print No. L-3- 25148, dated April 16, 1962, marked
"Exhibit A," attached to and made a part of said pipe line
license agreement; and
WHEREAS, said license agreement has this day been
submitted to the City Council for consideration, and the City
Council does find and determine that it would be for the benefit
and best interest of the City of Anaheim to enter into said
license agreement with said Railway Company.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the pipe line license agreement, dated
April 20, 1962, tendered to the City of Anaheim by the Atchison,
Topeka and Santa Fe Railway Company, a Kansas corporation,
licensing the City of Anaheim to construct, maintaina nd use,
solely for carrying sewage effluent, one pipe line 27" in diameter
across or along the right of way of the Atchison, Topeka and
Santa Fe Railway Company at or near the station of Atwood, Orange
County, California, subject to the terms, covenants and conditions
contained in said agreement, the exact location of said pipe line
being more particularly shown by red coloring upon said Railway
Companyfs print No. L-3- 25148, dated April 16, 1962, marked
"Exhibit A," attached to and made a part of said pipe line licence
agreement, be, and the same is hereby, approved and accepted.
AND BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said agreement above
mentioned for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 1st day of May, 1962.
