1962-0394RESOLUTION NO. 62R -39L A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 193. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from SILAS W. LEHMER, 1154 Cris Avenue, Anaheim, California, for a Conditional Use Permit to construct a single- family planned residential development on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The East 13 acres of the following described land: Beginning at a point on the South line of the South- east quarter of the Southwest quarter of Section 20, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, city of Anaheim, as shown on a map thereof recorded in book 51, page 10, Miscellaneous Maps, records of said Orange County; 487.2 feet West of the Southeast corner of said Southeast quarter of the Southwest quarter; and running thence West along the South line of said Southeast quarter of the Southwest quarter, 835 feet to the Southwest corner of said Southeast quarter of the Southwest quarter, said point being 1329.3 feet East of the Southwest corner of said Section 20; thence North, along the West line of the South- east quarter of the Southwest quarter of said section, to a point 130 feet South of the North line of the Southeast quarter of the Southwest quarter, thence East along the last mentioned line 835 feet; thence South to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on February 19, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Munici- pal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 234-.-Series 1961- 62, granting Conditional Use Permit No. 193, upon the condi- tions therein set forth; and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting said Conditional Use Permit and said appeal was set for public hearing on April 3, 1962, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Muni- cipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such -1- hearing and did give all persons interested therein an op- portunity to be heard and did receive evidence and reports, and did close said hearing and defer action to this date; and WHEREAS, because of a revision in the plans for said development, the hearing was reopened on April 2L, 1962, and all persons interested therein were given an opportunity to review said revised plans; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Com- mission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full develop- ment of the proposed use in a manner not detri- mental to the particular area nor to the peace, health, safety and general welfare. L. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said Conditional Use Permit be, and the same is hereby sustained, and that Conditional Use Permit No. 193 be, and the same is hereby, granted permitting the construction of a single family planned residential devel- opment on the property hereinabove described, subject to the following conditions: 1. That subject property shall be developed substan- tially in accordance with revised plans this day submitted to the City Council, which plans provide for 7L units, and are signed by Councilman Dutton; PROVIDED, HOWEVER, that the carport structures shall be enclosed on the rear and sides. 2. That a 6 -foot masonry wall shall be constructed along the west, north and east boundaries of subject property prior to final building inspection. 3. That a strip of land 6 feet in width abutting the south property line shall be landscaped and said landscaping maintained, with the exception of the area reserved for ingress and egress, and that plans -2- for said landscaping shall be submitted to and approved by the Superintendent of Parkway Main- tenance; that a masonry wall 6 feet in height shall be constructed along and abutting said landscaped strip; and that said landscaping and masonry wall shall be installed prior to final building inspection. 4. That the roofs of the residential structures to be erected on subject property shall be of shake roof construction. 5. That the owner of subject property shall deed to the City of Anaheim a strip of land 60 feet in width from the center line of the street,along Katella Avenue, for street widening purposes. 6. (a) That all engineering requirements of the City of Anaheim, along Katella Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 7. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Katella Avenue for street lighting purposes. 8. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 9. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 10. That modified cul -de -sacs shall be provided at the termini of Midwood Lane, Tamara Lane, and Folsom Street as required by the City Engineer, and that said cul -de -sacs shall be constructed prior to final building inspection. 11. That Conditions Nos. 5, 6(b), and 7, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said -3- owner, his heirs, successors, or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
