1962-0341RESOLUTION NO. 62R-341 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DETERMINING THE NECESSITY FOR, AND DIRECTING THE ACQUISITION BY EMINENT DOMAIN OF, REAL PROPERTY FOR PARK AND RECREATION PURPOSES. Finance Dir R/W WHEREAS, public convenience and necessity require the acquisition, improvement and maintenance of a public improvement within the City of Anaheim, towit: A public park, for park and recreation purposes; and WHEREAS, the City Council does find and determine that public interest and necessity require the acquisition of all that certain real property herein described by the City of Anaheim for the improvement and maintenance of a public park for park and recreation purposes; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that public interest and necessity re- quire the acquisition of that certain real property situated in the City of Anaheim, County of Orange, State of California, more particularly described as follows, to wit: That portion of the Northeast quarter of the North- west quarter of Section 28, Township 4 South, Range 10 West, S.B.B.& M., described as follows: Beginning at the Southeast corner of Tract No. 3240, as shown on a map recorded in Book 113, Pages 1, 2 and 3 of Miscellaneous Maps, Records of Orange County, California; thence North 0 55' 30" West 681.03 feet along the East line of said Tract No. 3240; thence leaving the East line of said Tract No. 3240, along a line bearing North 89 12' 43" East a distance of 661.44 feet to the intersection with the East line of the Northeast quarter of the Northwest quarter of said Section 28; thence South 0 55 10" East 579.03 feet along the East line of the Northeast quarter of the Northwest quarter of said Section 28, to a point distant 102.00 feet Northerly of the Southeast corner of the Northeast quarter of the Northwest quarter of said Section 28; thence South 89 12' 43" West 116.00 feet; thence South 29 09' 35" West 117.72 feet to the intersection with the South line of the Northeast quarter of the Northwest quarter of said Section 28, said point of intersection being distant South 89 12' 43" West 175.00 feet from the East line of the North- east quarter of the Northwest quarter of said Section 28; thence South 89 12' 43" West 486.37 feet along the South line of the Northeast quarter of the Northwest quarter of said Section 28, to the point of beginning. -1- BE IT FURTHER RESOLVED that the City Council does hereby find and determine that public interest and necessity require the acquisition of said land by the City of Anaheim for the improvement and maintenance of the aforesaid project, and that the taking of the property hereinabove described is necessary therefor, and that the use to which it is to be applied is a use authorized by law and the taking of said property is necessary to such use. NOW, THEREFORE, IT IS HEREBY AUTHORIZED that said property be acquired by the City of Anaheim, and the City Attorney of the City of Anaheim is hereby directed to insti- tute an action in eminent domain for the acquisition of the title to said property, and to perform and carry out all of the necessary proceedings and steps incident to the acquisi- tion of the title tosaid property and to obtaining possession thereof.
