1962-0810WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from WAYNE R. DAVIDSON, 1769 West Broadway, Anaheim, California, to construct an eight -unit, multiple family planned unit develop- ment on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: RESOLUTION NO. 62R -810 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT No. 280. That portion of the west half of the northeast quarter of the northeast quarter of section 17, Township 4 South, Range 10 West, in the Rancho Los Coyotes, county of Orange, state of California, as shown on a map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at the intersection of the center line of Broadway with the southerly prolongation of the East line of lots 19 to 22 inclusive of Tract No. 3562, as shown on a map recorded in book 128 pages 43 and of said Miscellaneous Maps; thence North 0 00' 4 West 347.66 feet along said southerly prolongation and said East line to the South line of lots 14 to 17 inclusive of said Tract No. 3562; thence South 89 31 00" East 155.08 feet along said South line; thence South 0 00' 48" East 90.71 feet parallel with said East line; thence South 45° 26' 28" West 23.79 feet; thence North 89° 33' 32" West 7.04 feet; thence South 0 00' 01" East 6.99 feet; thence South 45° 261 28" West 73.57 feet; thence North 89 331 2" West 23.59 feet parallel with said center line; thence South 0 00' 48" East 181.00 feet parallel with said East line to saidcenter line; thence North 89° 33' 32" West 55.06 feet to the point of beginning. Said land is included within the area shown on a map filed in book 50 page 24 of Record of Surveys, in the office of said county recorder. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on August 6, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. WI, Series 1962 -63 denying Conditional Use Permit No. 280; and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said Conditional Use Permit -1- STATE OF CALIFORNIA COUNTY OF ORANGE ss CITY OF ANAHEIM I, DENE M. WILLIAMS, City Clerk of the City of Anaheim, do hereby certify that the foreoing Resolution No.62R -810 was introduced and adopted at a regular meeting provided by law, of the City Council of the City of Anaheim, held on the 4th day, of September, 1962, by the following vote of the members thereof: AYES: COUNCILMEN: Dutton, Chandler, Krein and Coons. NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Schutte. AND I FURTHER CERTIFY that the Mayor of the City of Anaheim approved and signed said Resolution No.62R -810 on the 4th day of September, 1962. IN WITNESS WHEREOF, I have hereunto set my hand and affixed the official seal of the City of Anaheim this 4th day of September, 1962. (SEAL) CITY CLERK OF THE CITY OF ANAHEIM and did thereupon fix the 4th day of September, 1962, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 280 should be denied; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Conditional Use Permit No. 280 be, and the same is hereby, sustained and that the request of WAYNE R. DAVIDSON, 1769 West Broadway, Anaheim, California, for a Conditional Use Permit to construct an eight -unit, multiple family planned unit development on the property hereinabove described, be, and the same is hereby, denied.
