1962-0805RESOLUTION NO. 6g 8CG) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 62 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence pre- sented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 4th day of September 19 62 as the time and the City Council Chambers in the City• Hall of of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to. be heard, and did receive evidence and reports, and did thereupon con- sider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: Parcel 1: The west half of the south half of the southeast quarter cf the northeast quarter of section 27, Township I. South, Rance 10 Vest, in the Rancho San. Juan Cajon de Santa Ana, city of Anahc5r, county of Orange, state of California, as said section is shown on a map rect:rcied in boo ':r 51 trace 10 of I'iiscellancous Paps, in the office of the county recorder of said county. -1- 62 -63 -11 EXCEPT that portion thereof lying west of a line which is parallel with the east line of said section and which will intersect the south line of said northeast quarter at a point westerly 1,320.00 feet, measured along said south line from the east line of said section. Parcel 2. That portion of the south half of the south half of the northeast quarter of section 27, Township 4 South, Range 10 west, in the Rancho San Juan Cajon de Santa Ana, city of Anaheim, county of Orange, state of California, as said section is shown on a map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at an old stone monument set by H. Clay Kellogg, in the year 191 on the south line of said northeast quarter, being also the center line of Orangewood Avenue, West 667.00 feet from an old 2" by 4'" redwood stake monu- ment at the southeast corner of said northeast quarter; thence South 89° 33 45" West. 670.90 feet along said center line to an old stake and stone monument set by said H. Clay Kellogg; thence north. 0° 561 Lj51' West 660.28 feet to the north line of said south half of the south half of the northeast quarter of section 27; thence North 89° 3L.' 5i" East 668.23 feet along said north line; thence south 1° 10 10" Lest 660.04 feet to the point of beginning. EXCEPT that portion thereof lying east of a line which is parallel with the east line of said section and which will intersect the south line of said northeast quarter at a point westerly 1,320.00 feet, measured along said south line from the east line of said section. be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incor- porated in R -3, MULTIPLE- FAP RESIDENTIAL ZONE, upon the follow- ing conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land feet in width, from the center line of the street, along Orangewood Avenue for street widening purposes. 2. (a)That all engineering requirements of the City of Anaheir% along Orangewood Avenue and for one -half of a 64-foot street proposed to be const along the westerly line of subject property, such as curbs and gutters, sidewalks, street grading and paving, drain- age facilities, or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City tc guarantee the installation of said engineering requirements. 3. That the owner of subject property shall pay tc the City of Anaheim the sum of $2.00 per front foot along Orangewood Avenue, for street lighting purposes. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permits are issued. That adequate areas for trash storage, accessible to trash truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 6. That fire hydrants, as determined necessary by the Chief of the Fire Department to provide adequate fire protection, shall be installed prior to final building inspection. 7. That access drives to subject property shall be a minimum width of 21 feet, with adequate angle cutoffs, or a minimum width of 28 feet if no cutoffs are pro- vided, and, in all cases, shall have a minimum verti- cal clearance of 14 feet. 8. That the owner of subject property shall tender to the City of Anaheim an irrevocable offer of dedication of one -half (32 feet) of a 64 -foot wide street, said proposed street to be constructed along the westerly boundary of subject property, extending from Orange- wood Avenue to the northerly property line, and said half street to be constructed to City of Anaheim standards, and to be subject to inspection by and approval of the City Engineer. 9. That a 6 -foot masonry wall shall be constructed along the northerly property line. 10. That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of a 6 -foot fence or masonry wall along the westerly line of subject property within a period of two years from date hereof, or such further time as the City Council may grant. 11. That subject property shall be developed substantially in accordance with plans marked "Exhibits Nos. 1, 2 revised, and 3" on file with the City of Anaheim, EXCEPT that other than composition roofs shall be provided. 12. That the completion of these reclassification proceed- ings is contingent upon the granting of Conditional Use Permit No. 279. 13. That Conditions Nos. 1, 2(b), 3, 8 and 10 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Munici- pal Code to accomplish the objects herein found and determined to be necessary and proper.
