1962-0801RESOLUTION NO 62R 801 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELANG TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 62 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence pre- sented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 4th day of September 1962 as the time and the City Council Chambers in the City Hall of t e City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon con- sider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: The Northerly 129 feet, measured along the Easterly line of that portion of Lots 9 and 10 of the Miles Rancho, as shown on a map thereof recorded in Book 4, page 7 of Miscellaneous Maps, records of Orange County, California, bounded and described as follows: 62 -63 -5 Beginning at a point in the center line of the unnamed road shown on said map adjoining said Lots 9 and 10 on the North and known as Romneya Drive, distant thereon South 89 43' 20" West 328.98 feet from the intersection of said center line with the Northerly prolongation of the Easterly line of said Lot 10, said point of beginning being the intersection of said center line with the Easterly line or the Northerly prolongation thereof, of the tract of land described in the deed executed by Bank of America National Trust and Savings Association, in favor of David Corderman and wife, recorded July 29, 1942 in Book 1156, page 18 of Official Records; thence South 0 24' 00" East along said Easterly line of the Corderman tract of land, 238 feet; thence South 89 43' 20" West parallel with said center line of Romneya Drive, 363.58 feet to the center line of the unnamed road shown on said map adjoining said Lots 9 and 10 on the West and known as West Street; thence North 0 29' 10" West along said center line of West Street, 238 feet to said center line of Romneya Drive; thence North 89' 43' 20" East along center line of Romenya Drive 363.94 feet to the point of beginning; Excepting from said Northerly 129 feet, the Easterly 263 feet measured along said center line of Romneya Drive. be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incorporated in R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Romneya Drive and West Street, for street lighting purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit for the new unit is issued. 3. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. 4. (a) That all remaining engineering requirements of the City of Anaheim along West Street, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. -2- ATTEST: 5. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibit 1, Revised," signed by Mayor Coons, approved by the City Council on September 4, 1962, and on file with the City of Anaheim. 6. (a) That a 6 -foot masonry wall shall be con- structed along the southerly line of subject property, said wall to be reduced to 42 inches in height commencing at the front yard setback of the adjoining lot to the South; or (b) That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said 6 -foot masonry wall in the event the property to the South is not reclassified R -3 within a period of two years from date hereof. 7. That the completion of these reclassification proceedings is contingent upon the granting of Variance No. 1510. 8 That Conditions Nos. 1, 4(b) and 6(b) above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
