1962-0755RESOLUTION NO. 62R -755 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 270. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from HANOVER HOMES, INC., Anaheim, California, to establish and operate a Hofbrau on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The East 5 acres of the South 20 acres of Lot 32 of "Anaheim Extension" in the city of Anaheim, county of Orange, state of California, as surveyed by William Hamel December 11, 1868, and filed for record in the office of the county recorder of Los Angeles County, California, a copy of which is filed in book 3 pages 163 et seq., entitled "Los Angeles County Maps" in the office of the county recorder of Orange County, California. EXCEPT that portion lying southerly of the northerly line of land described in the deed to the City of Anaheim, recorded December 9, 1912, in book 224 page 110, Deeds. ALSO EXCEPT that portion lying northeast of the southwest line of land described in Parcel 2, of the deed to the State of California, recorded May 5, 1943, in book 1186 page 434, Official Records. ALSO EXCEPT the land described in the deed to the State of California, recorded August 18, 1950, in book 2058 page 420, Official Records. ALSO EXCEPT that portion described as follows: Beginning at a point on the West line of said East 5 acres, said point also being on the northerly line of West South Street 60.00 feet wide as shown on a map of Tract No. 1217, recorded in book 58 pages 26, 27 and 2 of Miscellaneous Maps, records of said Orange County; thence North 74 23 00" East along the northerly line of West South Street, a distance of 131.00 feet to the true point of beginning; thence North 15 17 55" West, parallel with the West line of said East 5 acres, a distance of 112.00 feet; thence South 7. 23 00" West parallel with the said northerly line of West South Street, a distance of 20.00 feet; thence North 15° 17 55" West, a distance of 70.00 feet; thence North 49 10 41" East, a distance of 18.96 feet to a point on the westerly line of Manchester Avenue, 155.00 feet wide; thence South L0 49 19" East alongsaid westerly line a distance of 32.15 feet to the beginning of a tangent curve concave to the southwest having a -1- AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on July 23, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 418, Series 1962 -63, denying Conditional Use Permit No. 270; and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denying said Conditional Use Permit, and said appeal was set for public hearing on August 21, 1962, at 7 :00 otclock P.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 270 should be denied; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Conditional Use Permit No. 270 be, and the same is hereby sustained, and that the request of HANOVER HOMES, INC., Anaheim, California, for a Conditional Use Permit to establish and operate a Hofbrau for the sale of sandwiches and "on- sale' beer on the property hereinabove described be, and the same is hereby, denied. THE FOREGOING RESOLUTION is approved and signed by me this 21st day of August, 1962. ATTEST: radius of 500.00 feet; thence southeasterly along said curve through a central angle of 16 30 00" an arc distance of 143.99 feet to a point, a radial line through said point bears North 65 40t 41" East; thence South 49 10 41" West, a distance of 55.70 feet; thence South 74 23 00" West along the northerly line of West South Street, a distance of 3.31 feet to the true point of beginning.
