A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DETERMINING THE NECESSITY
FOR, AND DIRECTING THE ACQUISITION, BY
EMINENT DOMAIN, OF REAL PROPERTY FOR
HIGHWAY EASEMENT AND PUBLIC UTILITY

WHEREAS, public convenience and necessity require the
acquisition of certain real property within the City of Anaheim
for the following purposes, to wit: highway easement and public
utility purposes; and
WHEREAS, the City Council does find and determine that
public interest and necessity require the acquisition of all that
certain real property herein described, by the City of Anaheim
for highway easement and public utility purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that public interest and necessity require
the acquisition of that certain real property situated in the
City of Anaheim, County of Orange, State of California, more
particularly described as follows, to wit:
An easement for road and public utility purposes
over, under and across a strip of land 12.00 feet
in width lying within Lot 2 in Section 5, Township
4 South, Range 9 West, S. B. B. M., as shown on
an official plat of said land filed in the District
Land Office March 23, 1875, said Lot 2 being shown
on a Licensed Surveyors Map filed in Book 1, Page
29 of Record of Surveys in the office of the County
Recorder of Orange County, California, the Southerly
line of said 12.00 foot strip being parallel with
and distant 65.00 feet South of the following
described line:
Beginning at the Northwest corner of Lot One of
Orange Grove Acres, as shown on a Map recorded in
Book 6, Page 42 of Miscellaneous Maps, records of
Orange County, California, said Northwest corner
being the intersection of the West line of said Lot
One and the center line of La Palma Avenue, 40.00
feet in width; thence North 73 44' 00" East a
distance of 81.32 feet to the beginning of a tangent
curve concave Northwesterly, having a radius of
1000 feet; thence Easterly and Northeasterly along
said curve through a central angle of 12 59' 14"
an arc distance of 226.67 feet to the beginning of
a tangent curve concave Southeasterly having a
radius of 1000 feet; thence Northeasterly and
Easterly along said curve through a central angle
of 31 09' 44 an are distance of 543.88 feet.
EXCEPTING THEREFROM the Northerly 154.23 feet as
conveyed to the City of Anaheim by deed recorded
December 6, 1960 in Book 5536, Page 516 of Official
Records of Orange County, California.
The South line of said 12.00 foot strip to terminate
at the intersection of the West line of Lot 2 and the
South line of the Northerly 154.23 feet of said Lot 2.
BE IT FURTHER RESOLVED that the City Council does here-
by find and determine that public interest and necessity require
the acquisition of said land by the City of Anaheim for the
aforesaid purposes, and that the taking of the property here
inabove described is necessary therefor, and that the uses to
which it is to be put are uses authorized by law, and the
taking of said property is necessary to such uses.
BE IT FURTHER. RESOLVED that the City Council does
hereby authorize the acquisition of said property by the City
of Anaheim, and the City Attorney of the City of Anaheim is
hereby directed to institute an action in eminent domain for
the acquisition of the title to said property, and to perform
and carry out all of the necessary proceedings and steps
incident to the acquisition of the title to said property and
to obtaining immediate possession thereof.
THE FOREGOING RESOLUTION is approved and signed by

NOES COUNCILMEN: -None.
ABSENT: COUNCILMEN: Krein.

AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said resolution on the 14th day of
