1962-0746RESOLUTION NO. 62R -746 WHEREAS, Southern California Edison Company, a corporation organized under the laws of the State of California, has tendered to the City of Anaheim a "Road Easement" granting to the City an easement for public road and highway purposes in, on, over and across the following described real property situated in the City of Anaheim, County of Orange, State of California, subject to the terms, covenants and conditions therein set forth: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING AN EASEMENT FOR PUBLIC ROAD AND HIGHWAY PURPOSES IN, ON, OVER AND ACROSS CERTAIN REAL PROPERTY, FROM SOUTHERN CALIFORNIA EDISON COMPANY. Thoseportions of the South half of Section 23, Township 4 South, Range 10 West, San Bernardino Base and Meridian, in the Rancho San Juan Cajon de Santa Ana as shown on a map recorded in Book 51, page 10, of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: PARCEL NO. 1: The Westerly 25 feet of the Easterly 45 feet of "th- portion of the Southwest quarter of said Section 23 included within a strip of land 270 feet in width, lying Northerly of and contiguous to the Northerly line of the Southern Pacific Company's right of way, as said right of way is described first in deed dated May 28, 1889 from Pacific Improvement Company, to Southern Pacific Railroad Company recorded in Book 570, page 288, of Deeds, in the office of the County Recorder of said County. EXCEPTING THEREFROM a strip of land, 50 feet in width, lying equally 25 feet on each side of the existing center line of Southern Pacific Company's main track (Tustin Branch). PARCEL NO. 2: The Easterly 25 feet of the Westerly 45 feet of that ,portion of the Southeast quarter of said Section 23 included within a strip of land 270 feet in width, lying Northerly of and contiguous to the Northerly line of the Southern Pacific Company's right of way as said right of way is described first in deed dated May 28, 1889 from Pacific Improvement Company to Southern Pacific Railroad Company, recorded in Book 570, page 288, of Deeds, in the office of the County Recorder of Los Angeles County. -1- R/W (SEAL) STATE OF CALIFORNIA) COUNTY OF ORANGE )ss. WILLIAMS, CITY CLERK of the City of Anaheim, do hereby certify that the foregoing Resolution No. 62R -746 was introduced and adopted at a regular meeting provided by law, of the City Council of the City of Anaheim, held on the 14th day of August, 1962, by the following vote of the members thereof: AYES: COUNCILMEN: Dutton, Schutte, Chandler, Coons NOES: COUNCILMEN: None ABSENT: COUNCILMEN: Krein AND I FURTHER CERTIFY that the Mayor of the City of Anaheim approved and signed said Resolution No. 62R -746 on the 14th day of August, 1962. CITY CLERK OF THE CITY OF ANAHEIM 7 0 SUBJECT TO: An easement for roadway purposes as granted to American Lace Paper Company by Northwestern Pacific Railroad by an instrument dated November 2, 1960 and recorded in Book 5528, page 189, of Official Records, in the office of the County Recorder of Orange County. Covenants, conditions, restrictions, reservations, rights and easements affecting the above described property, whether of record or not, including but not limited to those herein referred to. AND WHEREAS, the City Council finds that it is for the benefit and best interest of the City of Anaheim to accept said "Road Easement" this day submitted to the City Council by Southern California Edison Company. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the "Road Easement" this day tendered to the City by Southern California Edison Company, a corporation organized under the laws of the State of California, granting to the City, but subject to the terms, covenants and conditions therein contained, an easement for public road and highway purposes in, on, over and across that certain real property hereinabove described, be and the same is hereby approved and accepted. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby authorized to accept said easement for and on behalf of the City of Anaheim.
