1962-0734RESOLUTION NO. 628-734 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELAT]NG TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 62 -63 -1 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence pre- sented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 7th day of August 1962 as the time and the City Council Chambers in the City Hall of tie City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon con- sider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of Lots 15, 16 and 23 of Tract No..498, as shown on a Map recorded in Book 19, page 24 of Miscellaneous Maps, records of Orange County, California, and that portion of the Northwest quarter of Section 26, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, as shown on a -1- 62 -63- -1 Bldg R/W Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the intersection of the Westerly line of said Lot 23 with that certain line described in a deed to the State of California, recorded April 9, 1952 in Book 2313, page 103 of Official Records; thence South 1° 18 30" East 118.06 feet along said Westerly line to the Northeast corner of said Lot 16; thence North 89 55 31" West along the Northerly line of said Lot 16, a distance of 84.38 feet; thence South 42° 00' 00" East 127,06 feet; thence North 48° 00' 00" East 139.61.feet to the Southwesterly line of land described in a deed to the State of California, filed April 9, 1952 as Document No. 25258 in the office of the Registrar of Titles of Orange County, California; thence North 42° 00' 00" West 160.03 feet along said Southwesterly line and the Southwesterly line of said land of the State of California first above mentioned to the point of beginning. be excluded from R -A, RESIDENTIAL AGRICULTURAL ZONE, and in- corporated in M -1, LIGHT MANUFACTURING ZONE, upon the follow- ing conditions: 1. (a) That all engineering requirements of the City of Anaheim along Manchester Avenue, such as curbs and gutters, sidewalks, street grading and paving, drain- age facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering require- ments. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Manchester Avenue, for street lighting purposes. 3. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 4. That subject property shall be developed substantially in accordance with plans marked "Exhibit No. 1" on file with the City of Anaheim, except.that a 25 -foot minimum building setback shall be established. 5. That landscaping shall be installed and maintained in the parkway abutting subject property as indicated on Exhibit No. 1 on file with the City of Anaheim, as well as in a 6 -foot strip abutting the Manchester Avenue right of way; that plans for said landscaping shall be submitted to and approved by the Superinten- dent of Parkway Maintenance; and that said landscaping 2 ATTEST: shall be installed prior to final building in- spection. 6. That Conditions Nos. 1(b) and 2 above- mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and sub- mit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
