1962-0731RESOLUTION NO. 62R -731 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 260. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from Mr. Mrs. Cecil Miles Lancaster, 6136 Greenmeadow Road, Lakewood, California and Jusuke Ononue, Orange Avenue at Stanton Avenue, Anaheim, California, for a Conditional Use Permit to construct and operate a hospital and convalescent home on Parcel No. 1 hereinafter described, and to construct and operate a service station on Parcel No. 2 hereinafter described. That said Parcels Nos. 1 and 2 are situated in the City of Anaheim, County of Orange, State of California and are more particu- larly described as follows: PARCEL NO. 1 That portion of the East 10 acres of the South half of the Southeast quarter of the Northeast quarter of Section 14, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in book 51, page 11, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at a point in the South line of said Southeast quarter of the Northeast quarter which is distant there- on 190 feet Westerly from the Southeast corner of said Southeast quarter of the Northeast quarter, said South- east corner being the intersection of the center line of Orange Avenue with the survey center line of Beach Boulevard, and running thence Northerly parallel with the East line of said Southeast quarter of the Northeast quarter, 332.5 feet, more or less, to the South line of the North 5 acres of the East 10 acres of the South half of the Southeast quarter of the Northeast quarter of said Section 14; thence Westerly along said South line, 50 feet; thence Northerly parallel with the East line of said North 5 acres, 332.5 feet, more or less, to the North line of said North 5 acres; thence Westerly along said North line to the Southeasterly line of the 75 -foot strip of land described in the deed to Orange County Flood Con- trol District, recorded June 8, 1961, in book 5747, page 158, Official Records; thence Southwesterly along said Southeasterly line to the West line of said East 10 acres of the South half of the Southeast quarter of the North- east quarter of said Section 14; thence Southerly along said West line to the South line of said East 10acres; thence Easterly along said South line to the point of beginning. PARCEL NO. 2 That portion of the East 10 acres of the South half of the Southeast quarter of the Northeast quarter of Section 1L, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in book 51, page 11, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the Southeast corner of the Southeast quarter of the Northeast quarter of said Section 14, said point being the intersection of the center line of Orange Avenue with the survey center line of Beach Boulevard, and running thence Northerly along the East line of said Southeast quarter of the Northeast quarter, 195 feet; thence Westerly parallel with the South line of said Southeast quarter of the Northeast quarter, 190 feet; thence Southerly parallel with the East line of said Southeast quarter of the Northeast quarter; 195 feet to the South line of said Southeast quarter of the Northeast quarter; thence Easterly along said South line, 190 feet to the point of beginning; EXCEPTING THEREFROM the portion included within Beach Boulevard on the East. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on July 9, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 393 Series 1962 -63, granting Conditional Use Permit No. 260 upon' the conditions therein set forth; and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting said Conditional Use Permit and said appeal was set for public hearing on August 7, 1962, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Com- mission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full develop- ment of the proposed use in a manner not 2 detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said Conditional Use Permit be, and the same is hereby sustained, and that Conditional Use Permit No. 260 be, and the same is hereby, granted permitting the construction and operation of a hospital and convalescent home on Parcel No. 1 hereinabove described and the construc- tion and operation of a service station on Parcel No. 2 hereinabove described, subject to the following conditions: That this Conditional Use Permit is granted subject to all of the conditions set forth in Resolution No. 62R -730 adopted by the City Council on August 7, 1962, in Reclassification Proceedings No. 61 -62 -125, with the exception of Condition No. 5, which shall not apply, and subject further to the completion of said re- classification proceedings. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors, or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
