A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH ORANGE COUNTY
STREET LIGHTING MAINTENANCE DISTRICT NO. 8
FOR THE MAINTENANCE AND ENERGY FOR STREET
LIGHTS IN TRACT 2893 IN SAID STREET LIGHTING
MAINTENANCE DISTRICT NO. 8.
WHEREAS, the final Map of Tract 2893 was filed while
the area covered by said map was in unincorporated area and
the development of said Tract 2893 was in accordance with
County Standards; and
WHEREAS, the area covered by Tract 2893 was annexed
into the City of Anaheim prior to completion of the improve-
ments; and
WHEREAS, under County Standards for street lights
the developer was required to provide for installation of
ornamental street lights by an agreement with Southern
California Edison Company wherein developer was to pay the
cost of installation, together with the first year's energy
and maintenance costs to Edison Company, all facilities to
remain the property of Edison Company; and
WHEREAS, Tract 2893 was annexed to and became a
part of County Street Lighting Maintenance District No. 8 for
the purpose of continuing the maintenance and payment of energy
for such street lights; and
WHEREAS, upon annexation to the City of Anaheim, said
Tract 2893 was in the area to be served with electric energy
from the system of the Electrical Division of the City of
Anaheim and the contract with the Southern California Edison
Company and County Street Lighting Maintenance District No. 8
for maintenance and energy of the street lights is impractical;
and

WHEREAS, it is practical and in the best public
interest of the residents of Maintenance District No. 8 for the
County Street Lighting Maintenance District No. 8 to enter into
a contract with the City of Anaheim for the maintenance and
energy for street lights in Tract 2893 in said County Street
Lighting Maintenance District No. 8; and
WHEREAS, the City and said District desire to enter in-
to such contract the City of Anaheim to provide the maintenance
and energy for the same cost per street light as the Southern
California Edison Company provides said maintenance and energy
in the remainder of Street Lighting Maintenance District No. 8,
the light standards being installed by and remaining the prop-
erty of the City of Anaheim Light and Power Department, said
City having arranged with the developer of Tract 2893 regarding
the cost of installation and cost of energy through June 30, 1962.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the City of Anaheim and Orange
County Street Lighting Maintenance District No. 8 enter into
an agreement for the maintenance and energy for street lights
in Tract 2893 in said County Street Lighting Maintenance
District No. 8 upon the following terms and conditions:
County Street Lighting Maintenance District No. 8 shall
pay the City of Anaheim the sum of $3.00 per light per
month for 15 lights, being each 2500 lumen lights and
$7.95 per light for 2 lights, being each 20,000 lumen
Mercury Vapor lights, providing energy, repair and full
maintenance of said 17 street lights installed in Tract
2893 as per plan approved by County Board of Supervisors
as condition to the recordation of final Tract 2893.
Said Agreement shall start as of July 1, 1962, with
first payment due January 1, 1963, with payments there-
after bimonthly.
City of Anaheim shall provide energy for illumination of
15 lights, being each 2500 lumen lights and 2 lights,
being each 20,000 lumen Mercury Vapor lights installed
by the City of Anaheim for Tract 2893. Said light
standards and equipment shall remain the property of
the City of Anaheim Light and Power Department.
Tie term of said Agreement shall be for a period of
F±ze (5) years commencing July 1, 1962, and ending
June 30, 1967.
Said Agreement shall automatically be renewed on the
same terms at the end of its original term and at the
end of each additional term for an additional one -year
term, unless terminated by a 30 -day notice of such
termination by either party prior to the end of such
five -year term or 30 days prior to the end of any
extension thereof: Provided however said Agreement
shall au u: tically terminate upon withdrawal of said
Tract 2893 from County Street Lighting Maintenance
District No. 8.
BE IT FURTHER RESOLVED that the City Clerk and the
Mayor be, and they are hereby authorized to execute said agree-
ment for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
