1962-0693RESOLUTION NO. 62R 693 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1492 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from MARSHALL R. and DOROTHY R. BAUCOM, owners of certain real property s tua a ire tity of Ana e im, ounty of Orange, State of California, described as follows: The North 115.00 feet of the South 789,00 feet of the West 135.00 feet of that portion of the West half of the Southwest quarter of the Southeast quarter of Section 12, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, page 11 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the Southwest corner of the West half of said Southwest quarter; thence North along the West line of said West half, 1320 feet to the Northwest corner of said West half of the Southwest quarter of the Southeast quarter; thence East 330 feet; thence South 1320 feet; thence West 330 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on June 11, 1962 notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 360 Series 19 -62 9 recommending that Variance No. 1492 be granted, ,subiect to cert in conditions there'n set forth and WHEREAS, thereafter, within twenty -twc (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission granting said variance, and said appeal was set for public hearing on J11112 9 1 962 at 7:00 ooclock P.M. at the City a n t e ty o Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: -1- 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NON, THEREFORE, BE IT RESOLVED by.the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a waiver of the sideyard setback requirements to allow the construction of a block wall on the property hereinabove described, subject to the following conditions: such var their he Mun is ipa Said var Mun is ipa 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Dale Avenue for street widening purposes. 2. That subject property shall be developed substantially in accordance with plans marked "Exhibit No. 1" on file with the City of Anaheim. 3. That Condition No. 1 hereof shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant.
