1962-0692RESOLUTION NO. 62R 692 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO, 1488 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Carmen Scalzo owner of certain rea�1 property situated xn"fie City of 'Anaheim, County of Orange, State of California, described as follows: The South 85.00 feet of that portion of the Northwest quarter of the Northwest quarter of the Southeast quarter of Section 22, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a point in the West line of said Southeast quarter of Section 22, distant South 0 141 30" East 298.4 feet from the center of said Section, said center point being the intersection of the center line of Cerritos Avenue from the West with the North and South quarter Section line of said Section; thence from said point of beginning North 89 56 00" East 660.70 feet to a one -inch iron pipe, as shown on a Map filed in Book 15, page 4 of Record of Surveys in the office of the County Recorder of Orange County, Califor- nia; thence South 0 15 00" East 340.76 feet to a one -inch iron pipe, as shown on said survey; thence South 89° 55 30" West 660.75 feet to a point on said West line of the Southeast quarter, distant South 0 14 30" East 639.26 feet from the center of said Section: thence North 0 14 30" West 340.86 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the GityHall in the City of Anaheim upon said petition on June 11,1962 notice of which said public hearing was du y g ven as required by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 33 6 Series 19 61 -62 recommending that Variance No. '14.88 be grant subsect to certain conditions therein set forth and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon fo be held on the 24th day of July 19 62, at 7:00 o'clock P.M. in the City Hall in the City of Anahe m and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: NORM, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be and the same is hereby granted permitting the establishment of an "on -sale" liquor licensed restaurant on the property hereinabove described, subject to the following conditions: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 60 feet in width from the center line of the street along Harbor Boulevard, for street widening purposes. 2. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. 3. That all structures on the roof of the existing restaurant shall be painted the same color as the balance of the roof in order to maintain color harmony. That the "on -sale" of liquor shall be an incidental use in conjunction with the restaurant operation. 5. That Condition No. 1 above- mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, his heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
