1962-0689RESOLUTION NO, 62R -689 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 240. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from ALPINE DEVELOPMENT CO., 820 S. Grand, Santa Ana, Califor- nia, to allow on -sale beer and wine in an Italian Restaurant, and to establish a dance studio, on the following described property situated in the City of Anaheim, County of Orange, State of California: The Westerly 220 feet of the following: Commencing at a point 219.25 feet South of the Northwest corner of the South half of the Northwest quarter of the Northwest quarter of Section 12, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, in the City of Anaheim, County of Orange, State of California, running thence South 117 feet; thence East 1320 feet to the East line of the Northwest quarter of the Northwest quarter of said Section 12; thence North 117 feet; thence West 1320 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on June 11, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 34 7, Series 1961 -62, granting Conditional Use Permit No. 240, subject to the conditions therein set forth; and WHEREAS, thereafter within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Conditional Use Permit and did thereupon fix the 24th day of July, 1962, as the time and the Council Chamber in the City Hall of the City of Anaheim as the placefbr a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: -1- 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full develop- ment of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said Conditional Use Permit be, and the same is hereby sustained, and that Conditional Use Permit No. 24.0 be, and the same is hereby, granted permitting the sale of beer and wine in an Italian Restaurant, and the establishment of a dance studio, on the property hereinabove described, subject to the following conditions: 1. That the owners of subject property shall pay to the City of Anaheim the sums of $2.00 per front foot along State College Boulevard, for street lighting purposes. 2. That this Conditional Use Permit is granted subject to completion of modification of Reclassification No. 58- 59 -84. as stipulated in Reclassification No. 61 -62 -106. 3. That the sale of beer and wine as permitted by this Conditional Use Permit, shall be in an Italian Restaurant; that no bar shall be installed; and that all beer and wine shall be served at tables only. That landscaping shall be installed and maintained in the unpaved portion of subject property abutting the State College Boulevard right -of -way, approximately two feet in width; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to the issuance of a business license for the requested operation. 5. That Condition No. 1 hereof shall be complied with within a period of 180 days from date of the adoption of this resolution, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its Manx; successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
