1962-0658RESOLUTION NO. 62R -658 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELAfNG TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 61 -62 -112 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence pre- sented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 17th day of July 1962 as the time and the City Council Chambers in the City Hall of City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon con- sider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -112 PARCEL NO. 1: The South 330 feet of the hereinafter described real property. PARCEL NO. 2: The North 330 feet of the hereinafter described real property. Said real property is situated in the City of Anaheim, County of Orange, State of California and is more particularly described as follows: The West 1/2 of the South 1/2 of the Southeast 1 /4 of the Southeast 1 /4 of Section 8, Township 4 South, Range 10 West, S.B.B.& M.; EXCEPT the West 3 acres thereof and except the west 264 foot portion East of said 3 acres. ALSO EXCEPT the South 330 feet of the East 65 feet of said land. be excluded from the R -2, TWO FAMILY RESIDENTIAL ZONE, and incorporated in the following zone or zones, upon the conditions hereinafter set forth: That Parcel No. 1 above described shall be changed to C -2, GENERAL-COMMERCIAL ZONE; and That Parcel No. 2 above described shall be changed to M -1, LIGHT MANUFACTURING ZONE, upon the following conditions: 1. (a) That all engineering requirements of the City of Anaheim along Lincoln Avenue such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue, for street lighting purposes. 3. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. -2- ATTEST: That the owners of subject property shall deed to the City of Anaheim a 3 -foot public utility easement and a 2 -foot overhang easement along the westerly boundary of said property. 5. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department of the City of Anaheim. 6. That subject property shall be developed substantially in accordance with plans marked "Exhibits 1, 2, 3, 4, and 5" on file with the City of Anaheim. 7. That a 35 -foot landscaped setback area shall be established and maintained abutting the Lincoln Avenue right of way line; and that said land- scaping shall be installed prior to final building inspection. 8. That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of a 6 foot masonry wall where subject property abuts R -A, Residential Agricultural Zone property. 9. That Conditions Nos. 1(b), 2, 4 and 8 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
