1962-0638RESOLUTION NO. 62R -638 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 243. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from MARGARET K. HILL, 7366 West Manchester, Apartment "A," Los Angeles 45, California, for a Conditional Use Permit to construct a multiple- family planned unit development on Parcel No. 1 hereinafter described, and to construct a service station on Parcel No. 2 hereinafter described. That said Parcel Nos. 1 and 2 are situated in the City of Anaheim, County of Orange, State of California and are more particularly described as: PARCEL 1: That portion of Lot 21 in the J. D. Taylor Tract as shown on a map thereof recorded in book 36, pages 58 and 59, Miscellaneous Records of Los Angeles County, California, lying in the city of Anaheim, described as follows: Beginning at a point in the centerline of Cross Street, (now known as Jefferson Street) said point being the intersection of the Westerly prolongation of the Northerly line of said Lot 21; thence along the Northerly line of said Lot 21 North ?3 311 00" East, 292.42 feet; thence South 36 23 00" East, 488.54 feet; thence South 73° 23 00" West, 246.68 feet to the Northwest corner of Parcel 4 (description to follow); thence North 17 00 00" West, 144.26 feet; thence North 36 23 00" West, 140.75 feet; thence South 73 00 00" West, 160.00 feet to the centerline of said Jefferson Street, 40.00 feet wide; thence North 17 00 00" West along the centerline of said Jefferson Street, 185.00 feet to the point of beginning. EXCEPT THEREFROM that portion lying in Jefferson Street and future widening. Also the northerly 20.00 feet, the Northeasterly 20.00 and the Southerly 10.00 feet for alley purposes. A 20.00 cutoff for Northeast Southeast corners. PARCEL 2: Beginning at a point in the centerline of said Jefferson Street South 17 00 00" East, 336.08 feet from the centerline intersection of Jefferson Street and the Westerly prolongation of the Northerly line of said Lot 21; thence North 73° 00 00" East,93.00 feet; thence South 72 06 00" East, 140.07 feet; thence South 17 00 00" East, 45.61 feet; thence South 17 541 00" West, 126.97 feet to a point in the centerline of Santa Ana Canyon Road (60.00 feet wide); thence North 72 06 00" West, 164.83 feet to the centerline intersection of Jefferson Street and Santa Ana Canyon Road; thence North 17 00 00" West along the centerline of Jefferson Street, 135.75 feet to the point of beginning. EXCEPT THEREFROM that portion lying in Santa Ana Canyon Road and Jefferson Street and also a 10.00 strip of land along the Southeasterly line of said Parcel 2 for alley purposes. -1- AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on June 11, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 350 Series 1961 -62, granting Conditional Use Permit No. 243, upon the conditions therein set forth; and WHEREAS, thereafter within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Conditional Use Permit and did thereupon fix the 10th day of July, 1962, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conductsuch hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full develop- ment of the proposed use in a manner not detri- mental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting said Conditional Use Permit be, and the -2- same is hereby sustained, and that Conditional Use Permit No.243 be, and the same is hereby, granted permitting the construction of a multiple family planned unit development on Parcel No. 1 above described, and the construction of a service station on Parcel No. 2 above described,subject to the following conditions: That this Conditional Use Permit is granted subject to the conditions set forth in Resolution No. 62R -637, adopted by the City Council on July 10, 1962, in Re- classification Proceedings No. 61 -62 -107, and subject to the completion of said reclassification proceedings. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors, or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
