1962-0600RESOLUTION NO 62R-600 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its.findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan,- ning Commission, the City Council did fix the 26th day of Jurle 1% as the time, and the City Council Chambers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows -1- 6 PARCEL 1: That portion of Section 9 in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, as shown on a map thereof recorded in book 51, page 10, 1.1iscellaneous Maps, records of said Orange County, described as follows: Beginning at a point on the Northerly line of Lot 4, as shown on a map of survey of a portion of said Section 9 made for F. W. Fleischmann, and recorded in book 1, page 56, Record of Surveys, in the office of the County Recorder of said Orange County, distant Westerly 289.82 feet from the center line of West Street, as shown on said map; thence Southerly 1176.40 feet parallel with the Easterly line of the West half of the Northwest quarter of said section, to the Southerly line of said Lot 4; thence Westerly 684.00 feet along said Southerly line, to the Southwest corner of the land described in the deed to Vernon C. Starr and wife, recorded. July 31, 19L6, in book 1423, page 472, Official Records, in the office of the County Recorder of said Orange County; thence Northerly 228.00 feet along the Westerly line of said land conveyed to Starr, to the true point of beginning; thence Westerly 110.00 feet parallel with the Southerly line of said Lot 4; thence Northerly 198.00 feet parallel with the Westerly line of said land conveyed to Starr; thence Easterly 110.00 feet parallel with the Southerly line of said Lot 4, to the Northwesterly corner of said land conveyed to Starr; thence Southerly 198.00 feet to the true point of beginning. Parcel 2: The north 180.00 feet, measured along the westerly line of that portion of Section 9, Township L South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, as per map recorded in book 51, page 10 of Miscellaneous Maps, in the office of the County Recorder of said county described as follows Beginning at a point on the northerly line of Lot L, as shown on a Licensed Surveyor's Map of a portion of said Section 9, made for F. W. Fleischmann and as shown on a map of survey recorded in book 1, page 56, Record of Surveys, in the office of the County Recorder of said Orange County, 289.82 feet Westerly from the center line of West Street, as shown on said map; thence Southerly 1176.4 feet parallel with the Westerly line of the West half of the Northwest quarter of said section to the Southerly line of said Lot 4; thence Westerly 574 feet along said Southerly line, to the true point of beginning; thence Northerly 426 feet parallel with the Easterly line of the West half of the Northwest quarter of said Section 9; thence Westerly 110 feet parallel with the Southerly line of said Lot 4; thence Southerly 198.00 feet to the Northwesterly corner of the land conveyed to Edward A. Turner and wife by deed recorded January 30, 1951 in book 2137, page 11 of Official Records; thence Easterly 6 feet parallel with the Southerly line of said Lot 4 to the North- easterly corner of the land conveyed to Turner; thence Southerly 228.00 feet along the Easterly line of said land conveyed to Turner to the Southerly line of said Lot 4; thence Easterly 104 feet along said Southerly line to the point of beginning. -2- be excluded from the R -O, ONE FAMILY SUBURBAN ZONE, and incorporated in R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall place of record City of Anaheim R -3 Deed Restrictions, approved by the City Attorney, which restrictions shall limit all buildings constructed on subject property to one story in height. 2. That revised plans for the development of subject property for single story structures, with adequate access to the garage area, shall be submitted to and approved by the Planning and Building Departments prior to the issuance of any building permit. 3. That the owners of subject property shall deed to the City of Anaheim a strip of land 30 feet in width, from the monumented center line of Lido Place extended Easterly. 4. (a) That all engineering requirements of the City of Anaheim, for said Lido Place, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 5. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 6. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. 7. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Lido Place for street lighting purposes. 8. That the owners of subject property shall deed to the City of Anaheim a 3 -foot public utility easement and a. 2 -foot overhang easement along the Easterly boundary of subject property. 9. That Conditions Nos. 1, 3, 4(b) 7 and 8 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, an d he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Nunicipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
