1962-1043RESOLUTION NO. 62R -1043 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 309. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from MORTEN M. DIZNEY and MAUDE A. DIZNEY, c/o Harry M. Halstead, Attorney, 617 South Olive, Los Angeles, California, for a Conditional Use Permit to con- struct a planned unit development on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The East 9 acres of the West 14 acres of the North one -half of the Northeast quarter of the Northwest quarter of Section 24, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, Page 11 of Miscellaneous Maps, in the office of the County Recorder of said County. EXCEPTING THEREFROM the North 310.00 feet of the West 281.00 feet. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on October 1, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 507, Series 1962 -63, granting Con- ditional Use Permit No. 309, upon the conditions therein set forth; and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Conditional Use Permit and did thereupon fix the 30th day of October, 1962, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did continue said hearing to December 4, 1962; and WHEREAS, the City Council does find, after careful con- sideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearings, that Con- ditional Use Permit No. 309 should be denied. 1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion granting Conditional Use Permit No. 309 be, and the same is hereby disapproved, and that the request of MORTEN M. DIZNEY and MAUDE A. DIZNEY for a Conditional Use Permit to construct a planned unit development on the property hereinabove described be, and the same is hereby, denied.
