1962-0940RESOLUTION N0, 62R 940 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1521 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from ARTHUR W. KRUSE and EDNA H. KRUSE owners of certain real property s tua e iri tie ty of Ana a im, ounty of Orange, State of California, described as follows: Lots 4 and 5 of the South Street Tract, as shown on a map recorded in Book 8, Page 89 of Miscellaneous Maps, Records of Orange County, California. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on September 5, 1962 notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No, 485 Series 19,,62 -63 recommending that Variance No. 1521 be granted. ,�i hj Pr t _to certain conditions therein set forth and WHEREAS, thereafter, within twenty =twc (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission ranting said variance, and said appeal was set for public hear ing on October 16, 1962 at 7000 oQclock P.M. at the City a n y o A to itnaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18,76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: -1- 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NON, THEREFORE, BE IT RESOLVED by. the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting sales and service of automobiles on the property hereinabove described, as an addition to an existing facility located on property adjoining subject property on the north, subject to the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Los Angeles Street for street widening purposes. 2 That damaged and /or hazardous sidewalks, curbs and driveways on Los Angeles Street shall be repaired as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 3 That subject property shall be developed substantially in accordance with plans marked "Exhibit No. 1" on file with the City of Anaheim, with the exception that all buildings constructed on subject property shall face in the direction of South Street or on Los Angeles Street, and shall not open onto the alley; and that parking area shall be provided as required by the Anaheim Municipal Code. 4. That plans for all buildings proposed to be constructed on subject property shall be approved by the Architectural Control Committee. 5. That all repair work or auto detailing shall be performed between the hours of 8:00 A.M. and 6:00 P.M., EXCEPT that no work of this type shall be performed on Sundays. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is signed and approved by me this 16th day of October, 1962. ATTEST: IT 6. That Condition No. 1 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant.
