1962-0881RESOLUTION NO. 62R -881 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO.281. WHEREAS, the City Planning Couuuission of the City of Anaheim did receive a request for a Conditional Use Permit from RAYCO INVESTMENT CO., INC., 10502 West Katella Avenue, Anaheim, California, to construct a multiple- family planned unit develop- ment on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Parcel 1: The West 197.00 feet of lot 15 of Orangewood Tract, in the City of Anaheim, County of Orange, State of California, as per map recorded in book 7 page 42 of Miscellaneous Maps, in the office of the County Recorder of said County. EXCEPT that portion thereof lying South of a line parallel with and 990.00 feet north from the southline of lot 10 of said Orangewood Tract, measured along the West line of said lots 10 and 15. Parcel 2: Those portions of lots 10 and 15 of the Orange- wood Tract, in the City of Anaheim, County of Orange, State of California, as per map recorded in book 7 page 42 of Miscellaneous Maps, in the office of the County Recorder of said County, described as a whole as follows: Beginning at a point on the West line of said lot 10, distant northerly 440.00 feet from the southwest corner of said lot; thence northerly 550.00 feet along the West line of said lots 10 and 15; thence easterly along a line which is parallel with the South line of said lot 10 to the intersection of said parallel line with the East line of the west half of said lot 15; thence southerly along said East line to the South line of said lot 15; thence easterly along said South line to the northwest corner of Tract No. 2748, as per map recorded in book 93 pages 30 and 31 of Miscellaneous Maps; thence southerly along the Westerly boundary of said Tract No. 2748 to the intersec- tion of said westerly boundary with the North line of the South 220.00 feet of said lot 10; thence westerly along said North line to the west line of the East 495.00 feet of said lot 10; thence northerly along said west line to the north line of the South 440.00 feet of said lot 10; thence westerly along said northerly line to the point of beginning. EXCEPT that portion of the North 15 feet lying Easterly of the Westerly 197 feet thereof. Parcel 3: An easement for road purposes over the West 50.00 feet of the East 520.00 feet of the South 440.00 feet of lot 10 of the Orangewood Tract, in the City of Anaheim, County of Orange, State of California, as per map recorded in book 7 page 42 of Miscellaneous Maps, in the office of the County Recorder of said county. EXCEPT that portion thereof included within Parcel 2 above. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on August 6, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said vestigation and studies after due consideration said hearing, did adopt denying Conditional Use WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said Conditional Use Permit and did thereupon fix the 4th day of September, 1962, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did continue said hearing to October 9, 1962; and WHEREAS, the City Council does find, after careful con- sideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearings, that Con- ditional Use Permit No. 281 should be denied; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion denying Conditional Use Permit No. 281 be, and the same is hereby sustained, and that the request of RAYCO INVESTMENT CO., INC., 10502 West Katella Avenue, Anaheim, California, for a Con- ditional Use Permit to construct a multiple family planned unit development on the property hereinabove described be, and the same is hereby, denied. THE FOREGOING RESOLUTION is approved and signed by me this 9th day of October, 1962.
