A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AN AHEIM EMPLOYING HAROLD GIMENO
AS AN ARCHITECT TO RENDER ARCHITECTURAL
AND ENGINEERING SERVICES FOR THE DESIGN
AND CONSTRUCTION OF THE NEW FIRE STATION;
AND PROVIDING FOR COMPENSATION THEREFOR.
WHEREAS, the City Council finds that the City of
Anaheim is rapidly expanding in area and population, and
that the need for additional fire protection is imperative;
and
WHEREAS, the growing demand for fire protection
and anticipated future demand will tax the facilities of the
present Fire Department to adequately supply such protection
and demands in territories that have been, and which it is
anticipated will be, annexed to and become a part of the City,
and detailed plans and specifications for a new fire station
should be prepared and architectural and engineering services
for design, construction and supervision thereof should be
provided; and
WHEREAS, the City Council finds that Harold Gimeno,
A.I.A., Architect, having offices at 14162 North Main Street,
Santa Ana, California, is qualified and capable of making
such studies and surveys and of rendering architectural,
engineering and supervisory services, and that he has offered
to make preliminary sketches, prepare working drawings and
specifications, and provide architectural supervision of con-
struction upon the terms and conditions and for the compensa-
tion hereinafter more particularly set forth;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Harold Gimeno, A.I.A., Architect,
having offices at 14162 North Main Street, Santa Ana, Cali-
fornia, be, and he is hereby, employed by the City of Anaheim
to perform the following services:
1. Make preliminary sketches, including preliminary
studies of floor plans, plot plans, sections,
elevations and preliminary estimates.
2. Make working drawings and specifications, includ-
ing the preparation of floor plans, elevations,
sections and interiors, large scale architectural,
structural, mechanical and electrical engineering
details, complete specifications, including specifi-
cations for equipment and blueprints for plan
checking and construction purposes.
3. Supervision of construction, including analysis of
bids for construction, examination of all bills
for payments to contractors, keeping of records
of payments, and rendering architectural super-
vision of the work.
BE IT FURTHER RESOLVED that the said Harold Gimeno
shall receive as full compensation for the services herein
above mentioned and described, eight per cent (8 of the
construction cost of the new fire station, payable in the
following manner and subject to the following provisions:

1. Three- fourths (3/4) of the fee shall be paid
to the architect when an acceptable bid has
been received by the owner.
2. No payment shall be paid to the architect until
an acceptable bid has been received.
3. The remaining one fourth (1/4) of the fee shall
be paid to the architect during the construction
of the fire station at the same time and pro-
portioned to the periodic payments which are
made to the contractor or contractors.
BE IT FURTHER RESOLVED that if, at any time during
the term of employment, it is desired to cancel the contract
with said Harold Gimeno and an equitable adjustment cannot be
arrived at between the City of Anaheim and said Harold Gimeno,
the matter shall be settled by arbitration, in accordance
with the statutory provisions of the State of California then
in force. Three arbitrators shall be selected, one by the
City, one by Harold Gimeno, and the third by the first two,
and a majority decision of the three shall be binding on the
City and said Harold Gimeno; and
BE IT FURMER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized and directed to make
and execute a contract for and on behalf of the City of
Anaheim with Harold Gimeno upon the terms and conditions
herein specified.
THE FOREGOING RESOLUTION is signed and approved by
me this 9th day of November, 1 954.

and signed said resolution on the 9th day of November, 1954.
