A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM REVERSING THE ACTION OF THE CITY
PLANNING COMMISSION, AND DENYING APPLICATION
FOR VARIANCE NO. 244 REQUESTING PERMISSION TO
ERECT A SERVICE STATION AT 1109 EAST CENTER
STREET IN THE CITY OF ANAHEIM.
WHEREAS, the City Planning Commission of the City
of Anaheim did receive a petition from the property owners
of certain real property situated in the City of Anaheim,
County of Orange, State of California, described as follows:
Northwest corner East and Center Streets,
Anaheim, California, and more particularly
described as:
That portion of Block "C" of Kroegers Sub-
division of Vineyard Lot D -1, Anaheim, in
the City of Anaheim, County of Orange, State
of California, as per map thereof recorded
in Book 5, Page 34 of Miscellaneous Maps,
Records of said County, described as follows:
Beginning on the southerly line of said Block
"C at a point 2.5 westerly from the south-
easterly corner of said Block "C thence
northerly parallel with the easterly line of
said Block "C" 1351 to the southeasterly
corner of land conveyed to Fred Samuel and
wife by deed recorded April 27, 1946, in Book
114.02, Page 455, of Official Records; thence
westerly along the southerly line of said
land conveyed to Fred Samuel, a distance of
99.15' to the northeasterly corner of Lot 1
of Tract No. 1157, as per map thereof recorded
in Book 40, Pages 34 and 35 of Miscellaneous
Maps, Records of said County; thence southerly
along the easterly line of said Lot 1 of said
Tract No. 1157, a distance of 135 feet to the
southerly line of said Block "C thence
easterly along the southerly line of said Block
"C" to the point of beginning.
AND WHEREAS, the City Planning Commission did hold
a public hearing at the City Hall in the City of Anaheim on
Monday, the 23rd day of August, 1954, notices of which said
public hearing were duly given as required by law and the
provisions of Section 9200.17 of the Anaheim Municipal Code;
an d
WHEREAS, said City Planning Commission, after due
inspection, investigation and studies made by itself and in
its behalf, and after due consideration of all evidence and
reports offered at said hearing, did adopt Resolution No. 21
Series 1954 -55, granting Variance No. 244 upon the conditions
stated in said resolution; and
WHEREAS, thereafter, within twenty (20) days from
the date of the adoption of said resolution, written appeals

were filed with the City Council of the City of Anaheim
opposing the granting of said variance, and said appeals
were set for public hearing on the 13th day of October,
1954 at 8:00 o'clock F.M. at the City Hall in the City of
Anaheim, and notice of such public hearing was duly given
as required by law and the provisions of Section 9200.17
of the Anaheim Municipal Code; and
WHEREAS, after due investigation and studies
made by itself and in its behalf, and after due considera-
tion of all the evidence and reports offered at said hear-
ing, the City Council does find and determine that:
NOW, T: _REFOhE, BE I`T RESOLVED by the City Council
of the City of Anaheim, that the action of the City Planning
Commission granting Variance No. 244 requesting permission
to erect a service station at 1109 East Center Street in the
City of Anaheim, be, and the same is hereby, reversed, and
said variance is hereby denied.

possessed by other property in the same
vicinity and zone and denied the subject
property.
2. It appears that the subject property can
be adequately developed and used under
the present zone.

ABSENT: COUNCILMEN: Pearson and Wisser.
AND I FURTHER CERTIFY THAT the Mayor of the City of
Anaheim approved and si said Resolution on the 26th day of
October, 1954.
