1954-2539RESOLUTION NO. 2539 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE EXECUTION AND DE- LIVERY BY THE CITY OF ANAHEIM OF A COVENANT OF WARRANTY OF TITLE TO CERTAIN REAL PROPERTY SOLD AND CONVEYED BY THE CITY OF ANAHEIM TO JAMES S. BEATTIE AND EMILY BEATTIE, HUSBAND AND WIFE. WHEREAS, pursuant to a resolution adopted by the City Council on the 9th day of March, 1954, a deed was duly made and executed by the Mayor and the City Clerk of the City of Anaheim conveying the hereinafter described real property to James S. Beattie and Emily Beattie, husband and wife, which said deed was recorded in the Office of the County Recorder of Orange County, California on the 12th day of March, 1954, in Book 2687, Page 307 of Official Records; and WHEREAS, the City Council of the City of Anaheim does find and determine that it is now necessary and ad- visable that the City of Anaheim execute and deliver to said James S. Beattie and Emily Beattie, husband and wife, a covenant of warranty of title to said property conveyed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Mayor and the City Clerk be, and they are hereby, authorized and directed to make, execute and deliver to James S. Beattie and Emily Beattie, husband and wife, a covenant of warranty of title whereby the City of Anaheim shall covenant to warrant and defend unto the said James S. Beattie and Emily Beattie, their heirs and assigns, forever, against the lawful claims of all persons whomsoever, the title to the following described real property situated in the City of Anaheim, County of Orange, State of California, to wit: A tract of land in the City of Anaheim, County of Orange, State of California, being a portion of the Southwest quarter of the Southeast quarter of Section 3, Township 4 South, Range 10 West, San Bernardino Base and Meridian, and more particularly described as follows: Beginning at a point on the North line of East La Palma Avenue, which point is 30 feet North of the monumented center line of said East La Palma Avenue and 30.18 feet East of the monu- mented center line of North Olive Street; thence Northerly along a line parallel to the monu- mented center line of said North Olive Street a distance of 132.50 feet to the true point of beginning; thence continuing Northerly along a line parallel to said monumented center line of North Olive Street a distance of 157.50 feet to a point; thence East along a line parallel to the North line of said East La Palma Avenue a distance of 200 feet to a point; thence southerly along a line parallel to the monu- mented center line of said North Olive Street a -1- distance of 157.50 feet to a point; thence West along a line parallel to the North line of said East La Palma Avenue a distance of 200 feet to the point of beginning. RESERVING to the City of Anaheim an easement for public utilities over, under or across the Easterly five (5) feet of said tract. SUBJECT to all conditions, restrictions, easements, reservations, rights and rights of -way of record. THE FOR FflOING RESOLUTION is approved and signed by me this 13th day of October, 1954.
