1954-2516RESOLUTION NO. 2516 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CONSENTING TO THE ANNEXATION TO THE CITY OF FULLERTON OF A PORTION OF HOUSTON STRIO;T, AND CONSENTING TO AN ADJUSTMENT OF THE COMMON BOUNDARY LINE BETWEEN THE CITY OF ANAHEIM AND THE CITY OF FULLERTON. WHEREAS, there has been filed with the City Council of the City of Anaheim a written petition requesting consent of the City Council of the City of Anaheim to the annexation to the City of Fullerton of that portion of Houston Street hereinafter more particularly described, a portion of which is within the City of Anaheim and a portion of which is south of the common boundary line between the Cities of Anaheim and Fullerton as heretofore established by agreement; and WHEREAS, said petition is signed by at least two thirds of the freeholders, holding at least two thirds in value of the property in that portion of said territory now within the corporate limits of the City of Anaheim; and WHEREAS, said petition contains the written consent of said parties to the annexation of said territory to the City of Fullerton; and WHEREAS, the agreement heretofore made and entered into by and between the City of Fullerton and the City of Anaheim establishen a common boundary between said cities provides for the alteration and adjustment of said boundary when necessary for the proper development of the areas ad- jacent to said boundary line as established, by mutual con- sent of said cities; and WHEREAS, the City Council finds that the Division of Highways of the State of California contemplates the establishment of a freeway extending in an easterly and westerly direction ad joininc; the south boundary line of Houston Street as now established, and that the property owners along the north side of that portion of Houston Street hereinafter described, own the fee title to the south boundary line of said street, and that the balance of the property owned by them is situated north of the common boundary line established between the two cities and that, therefore, it would be for the best interest of the owners of said property and the development of said area that the City Council con- sent to the annexation by the City of Fullerton of that por- tion of the hereinafter described property which is now within the city limits of the City of Anaheim, and that it consent to an alteration of the common boundary line between the two cities as to that portion of the hereinafter de- scribed property which is not within the city limits of the City of Anaheim, and that the common boundary line between the two cities should be fixed as the south boundary line of Houston Street is now established in that area encompassed within the territory hereinafter described. NOW, THLREFO E, BE IT RESOLVED by the City Council of the City of Anaheim that consent be, and it is hereby, given to the City of Fullerton to, annex the following de- -1- scribed territory, a portion of which is now within the city limits of the City of Anaheim, to wit: All those portions of fractional Sections 5 and 6, Township 4 South, Range 10 West, S.B.B. M., in the County of Orange, State of California, more par- ticularly described as follows, to wit: Beginning at a point on the southerly boundary line of the City of Fullerton, as same existed on July 9, 1954, said point being the Southeast corner of Lot 12 of Baker and Loveringts Subdivision, as shown on a map thereof recorded in Book 31, Page 84, Miscel- laneous Records, Los Angeles County, California, said point also being on the North line of Houston Street, 60 feet wide, as described in a petition presented by J. H. Whitaker, et al., and accepted by the Board of Supervisors of said County of Orange on December 7, 1896, recorded in Road Book, Volume 1, Page 204, Records of the Orange County Clerk; thence, from said point of beginning, Southerly 60 feet, along the Southerly prolongation of the East line of said Lot 12, to the South line of said Houston Street; thence Westerly 2820.61 feet, more or less, along said South line of Houston Street and the Westerly prolongation thereof to the center line of Brookhurst Road, 60 feet wide, said center line also being the West line of said Section 5; thence, continuing Westerly 30 feet along said West- erly prolongation of said South line of Houston Street to the West line of Brookhurst Road; thence, Northerly, parallel wLth and distant 30 feet Westerly from said center line of Brookhurst Road, distant 60 feet, more or less, to a point, said point being a Southwest corner of the Orangethorpe No. 2 Annexa- tion to said City of Fullerton, as certified by the Secretary of State of the State of California, on the 8th day of January, 1954, said point also being on the Westerly prolongation of the North line of said Houston Street; thence, Easterly 2850.61 feet, more or less, along said Southerly boundary line of Fullerton to the point of beginning, and containing an area of 3.93 acres, more or less. AND BE IT FURTHER RESOLVED that the common boundary line between the Cities of Anaheim and Fullerton be established as the south line of Houston Street along that portion of said Houston Street hereinabove described.
