1954-2487-ARESOLUTION NO. 2487-A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHIORIZING THE PURCHASE AND ACQUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC PURPOSES. WHEREAS, Ivan Wells Sons, a copartnership consist- ing of Ivan M. Wells, Donald D. Wells and Eugene W. Wells are the owners of the hereinafter described real property situated within the County of Orange, State of California; and WHEREAS, the owners of said property have offered to sell said property to the City of Anaheim for the sum of $3,000.00; and WHEREAS, the City Council does find and determine that public convenience and necessity require the acquisition of said parcel of real property; that said property is needed for public use and that the price which the owners thereof are willing to accept is reasonable and not out of proportion to the reasonable market value of said property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of Ivan Wells Sons, a copartnership, to sell all that certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lot 98 of Tract No. 1803, in the City of Anaheim, County of Orange, State of Cali- fornia as per map recorded in Book 56, Pages 45, 46 and 47 of Miscellaneous Maps in the Office of the County Recorder of said County, for the sum of $3,000,00 cash, lawful money of the United States, be, and the same is hereby, accepted, and that the deed tendered by said owners be accepted subject to the terms and conditions hereinafter stated; and BE IT FURTHER RESOLVED that the City Treasurer be, and he is hereby, authorized to deposit in escrow with Title Insurance and Trust Company of Santa Ana, California the sum of $3,000.00, the purchase price of said property; and that when said Title Company can issue its policy of title insur- ance showing said property to be vested in the City of Anaheim free and clear of all encumbrances, except taxes for the fiscal year 1954 -55, and showing said property to be excepted from Provision No. 1 of that certain Declaration of Restrictions made by Ivan Wells Sons and recorded February 24, 1954 in Book 2674, Page 386 of Official Records of Orange County, California, but subject to public utility easements of record, that said deed tendered by said owners shall be recorded and such policy of title insurance shall be issued showing said property vested in the City of Anaheim as hereinabove specified, and that the purchase price shall be thereupon paid to the owners of said property; and -1- BE IT FURTHER RESOLVED that the sellers shall pay the usual and customary sellers' charges for furnishing a policy of title insurance necessary to show title vested in the City of Anaheim as herein provided, and that the City of Anaheim shall pay the usual buyer's charges in the pur- chase of said property.
