A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE PAYMENT
BY THE CITY OF ALL FEES, COSTS AND EXPENSES
INVOLVED IN THE HEARING AND FINAL DISPOSI-
TION OF THE ACCUSATION FILED AGAINST THE
CITY CLERK, CHARLES E. GRIFFITH.
WHEREAS, Section 2001 of the Government Code of the
State of California provides that whenever any action or pro-
ceeding, including a tax payer's suit, is brought against any
officer in his official or individual capacity, or both, of
the state, or any district, county or city, on account of any
action taken or work done by him in his official capacity, in
good faith and without malice, that all fees, costs and ex-
penses involved therein are a lawful charge against the state,
school district, county or municipality as the case may be;
and
WHEREAS, an accusation has been returned against
Charles E. Griffith, City Clerk, to remove him from office,
charging that he did mail out applications for absentee
ballots and absentee ballots to registered voters without
first having on file in his office a signed written applica-
tion therefor; and
WHEREAS, considering all of the information avail-
able to it at the present time, the City Council believes
that the said Charles E. Griffith acted in good faith and
without malice.
NOW, THEREFORE, BE IT RESOLVED by the City Council
that all fees, costs and expenses involved in the defense
of Charles E. Griffith in the proceeding relating to the
accusation filed against said Charles E. Griffith as City
Clerk for his removal from office, be, and they are hereby,
declared to be a lawful charge against the City of Anaheim.
THE FOREGOING RESOLUTION is signed and approved by
me this 26th day of March, 1 954.

March, 1954,
