1953-2180RESOLUTION NO. 2180 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM EMPLOYING QUINTON ENGINEERS, LTD. TO MAKE AND PREPARE DETAILED PLANS AND SPECIFICATIONS FOR A WATER STORAGE RESERVOIR AND PUMPING STATION FOR THE CITY OF ANAHEIM; PROVIDING FOR SUPERVISION AND ASSISTANCE IN THE CONSTRUCTION OF SAID RESERVOIR AND PUMP- ING STATION AND FIXING THEIR COMPENSATION. WHEREAS, the City Council finds that the City of Anaheim is rapidly expanding in area and increasing in popu- lation and there is an ever increasing demand for water for domestic, commercial and industrial purposes; and WHEREAS, the growing demand for water and the anticipated future demand for water will tax the facilities of the City Water Department to adequately supply such de- mands, and that it is necessary to construct a water storage reservoir and pumping station to supply the future demands for water in territories which it is anticipated will be annexed to and become a part of the City, and that detailed plans and specifications for such water storage reservoir and pumping station should be prepared; and WHEREAS, the City Council finds that Quinton Engineers, Ltd., a firm of consulting engineers having their offices at 816 South Figueroa Street, Los Angeles, Cali- fornia, are qualified and capable of making such studies, surveys and preparing such detailed plans and specifica- tions; and that they have offered to make soil investiga- tions, detailed surveys and prepare such detailed plans and specifications for the construction of the ground storage reservoir and pumping station and to prepare contract documents, including specifications, and provide general supervision, including assistance in the advertising and taking of bids, advice on award of contract, checking shop drawings and occasional visits to the project during the construction, upon the terms and conditions and for the compensation hereinafter more particularly set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Quinton Engineers, Ltd. of 816 South Figueroa Street, Los Angeles, California, consulting engineers, be, and they are hereby, employed by the City of Anaheim to perform the following services: 1. Make soil investigations to determine the bearing capacity and soil composition as a basis for design of the earth fill for the reservoir and other structures required. 2. Make detailed surveys as needed to augment cross sections and other available property data of the site provided by the City. 3. Prepare plans and details for the construction of the ground storage reservoir and pumping station. -1- 4. Prepare contract documents, including detail, design and specifications for said reservoir and pumping station. 5. To generally supervise the construction of said water storage reservoir and pumping station as required by the City of Anaheim, and to render assistance when re- quired in the advertising and taking of bids and the award of contract, in checking shop drawings and visits to the project during construction. 6. To make estimates of quantities and costs. 7. To make analysis of bids received for the construction of said reservoir and pumping station. 8. Upon completion of the project the preparation of "as built" drawings from information furnished by the resident engineer; and BE IT FURTHER RESOLVED that said Quinton Engineers, Ltd. shall receive as full compensation for the services here- inabove mentioned and described, for a three million p,000,000) gallon ground storage reservoir and pumping station, for a construction cost not to exceed $200,000.00, or 6.5% for a construction cost of $150,000.00, and if the actual project cost falls between the above amounts, compensation shall be in direct proportion; and that for reproduction of final plans and specifications in excess of six copies for the use of the City, said Quinton Engineers, Ltd. shall receive actual cost, plus 20% for handling; and BE IT FURTHER RESOLVED that the City Council may, at its discretion, require said Quinton Engineers, Ltd. to furnish detailed supervision during construction by furnishing the services of a resident engineer at a per diem cost of $45.00, including all mileage and other normal expenses; and BE IT FURTHER RESOLVED that said engineers complete and deliver the final plans and specifications to the City of Anaheim on or before days from and after the date of adoption of this resolution; and BE IT FURTHER RESOLVED that if at any time during the term of employment it is desired to cancel the contract with said Quinton Engineers, Ltd. and an equitable adjustment cannot be arrived at between the Ciir of Anaheim and said Engineers, the matter shall be settled by arbitration in ac- cordance with the statutory provisions of the State of California then in force. Three arbitrators shall be selected, one by the City, one by Quinton Engineers, Ltd., and the third by the first two, and a majority decision of the three shall be binding upon the City and said Quinton Engineers, Ltd.; and BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized and directed to make and execute a contract for and on behalf of the City of Anaheim with said Quinton Engineers, Ltd. upon the terms and conditions herein specified.
