RESOLUTION GRANTING A VARIANCE
WHEREAS, Wm. F. Smith, the owner of certain real property
situated in the City of Anaheim,County of Orange, State of
California, described as Lot 22, Block A, Owens and Jones Tract,
has filed with the City Planning Commission of the City of
Anaheim, apetition requesting that a variance be granted permit-
ting the construction of a second story on his garage at the rear
of his property at 734 North Clementine Street, and to use the
same for a rumpus room and additional sleeping quarters for guests
and
WHEREAS, the City Council finds from consideration and
investigation of the facts and the sentiments expressed by
persons residing in the vicinity of said real property that:
(1) Special circumstances and exceptional conditions do
exist as to the above described real property that do not apply
generally to the property or classes of uses in the same zone or
district.
(2) That a variance is necessary for the preservation and
enjoyment of a substantial property right of said petitioner.
(3) That the granting of such conditional variance will
not be detrimental to the public w4lfare or injurious to the pro-
perty or improvements in the district wherein said property is
located, provided the conditions hereinafter set forth are
complied with.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ANAHEIM, that a conditional variance be,and the same
is hereby granted for the construction of a second story on the
garage at the rear of the property at 734 North Clementine Street,
upon the following conditions:
1. That the appearance of said real property including all
buildings and improvements thereon shall be kept and maintained
with a satisfactory appearance in keeping with the use herein
permitted.
(2) That rental of the proposed new quarters is prohibited.
(3) That the owner is prohibited from moving into the new
quarters and renting the main front residence.
(4) That provision for the preparation and serving of meals
in the new quarters is prohibited.
The foregoing resolution is signed and approved by me this
