01/27/2026ANAHEIM CITY COUNCIL REGULAR MEETING OF JANUARY 27, 2026 The regular meeting of January 27, 2026 was called to order at 2:01 P.M. in the Council Chamber of Anaheim City Hall, located at 200 South Anaheim Boulevard. The meeting notice, agenda, and related material were duly posted on January 22, 2026. MEMBERS PRESENT: Mayor Ashleigh E. Aitken and Council Members Carlos A. Leon, Ryan Balius, Natalie Rubalcava, Norma Campos Kurtz, Kristen M. Maahs, and Natalie Meeks. STAFF PRESENT: City Manager Jim Vanderpool, City Attorney Robert Fabela, and City Clerk Theresa Bass ADDITION SIDELETIONS TO CLOSED SESSION:r City Attorney Fabela reported that Closed Session Item No. 1 has been removed from the Closed Session agenda. PUBLIC COMMENTS ON CLOSED SESSION ITEMS: Tom Fielder expressed concerns regarding alleged corruption in the City. He noted his community involvement, including volunteer work with the People's Homeless Task Force. He provided an overview of events related to the sale of Angel Stadium, leadership changes in the City, and subsequent investigations into the City. He urged City officials to take accountability and called for the resignation of City Manager Jim Vanderpool. Francisco Rosas addressed the City Council regarding concerns over City Manager Jim Vanderpool and his appointment. He referenced past corruption from former City officials and questioned the City's oversight and accountability. He criticized the City's prior actions related to Angel Stadium and Disneyland Forward and perceived prioritization of business interests over residents. He called for the resignation of City Manager Jim Vanderpool and accountability for those involved. Marc Herbert expressed concerns regarding the City Council's lack of follow-up actions after the release of the 2023 investigative report and transparency and accountability. He urged the City Council to address the culture in the City and called for the resignation of City Manager Jim Vanderpool. He cited concerns related to oversight and auditing of the Anaheim Tourism Improvement District. Jeanine Robbins alleged a culture of corruption within City Hall and criticized the City Manager's leadership and oversight. She expressed concern regarding transparency, interactions with lobbyists, oversight of City communications, and oversight over COVID funds provided to the Chamber of Commerce. She shared concerns about a lack of accountability and trust in City leadership and called for the termination of City Manager Vanderpool. Stephanie Mercadante emphasized the public's right to transparent and accountable governance. She cited findings from the JL Group report and raised concerns about the City Manager's involvement and communications with Council Members. She expressed concern about public trust and accountability and called for changes in City leadership to restore public trust. Vern Nelson expressed concern about City decisions made out of the public view and to the benefit of special interests. He referenced the investigation into former Mayor Harry Sidhu and the independent investigation. He expressed concern that findings in the report were not fully addressed or publicly discussed, particularly allegations involving staff. He called for greater reform and accountability in City government. Kenneth Batiste expressed concern regarding ethics, accountability, and decision -making by City leadership. He criticized the former sale of Angel Stadium, special interest influences, and the appointment of City Manager Vanderpool. He emphasized the importance of public trust and accountability. He called for leadership changes in the City. Mike Robbins shared concerns about ongoing corruption and the lack of transparency within City government under the leadership of City Manager Vanderpool. He explained that the current leadership undermines public trust and called for a change in leadership to restore accountability and transparency. Dave Duran expressed concerns regarding transparency, accountability, and public trust in City leadership. He stated that a lack of action from officials contributes to public distrust. Joshua Cadiz, Claims Assistant with the Workers' Compensation division, shared that the City is experiencing staffing shortages, causing excessive workload and extended overtime hours. He described working beyond his classification and expressed concerns regarding chronic understaffing, excessive workload, and lack of work -life balance. He highlighted the importance of maintaining in- house services and described challenges related to limited resources and support. He requested improved staffing, resources, and support to better support City employees and maintain a sustainable work environment. Christy Soukaseum spoke in support of keeping Workers' Compensation services in-house. She shared her industry experience and emphasized the value of personalized service and established relationships with City employees, particularly firefighters. She noted current staffing levels and increasing workload demands, stating that maintaining service quality requires significant effort. She expressed concerns about outsourcing, citing potential impacts on service and job security, and urged the Council to retain in-house operations and invest in additional staffing and resources. Sandra Lozeau, President of the American Federation of State, County and Municipal Employees (AFSCME), spoke in support of maintaining and strengthening the City's in-house Workers' Compensation program. She emphasized the importance of providing trusted care for public safety employees and shared personal experiences, emphasizing the need for effective support systems. She referenced prior studies recommending an in-house model with additional staffing and noted current vacancies and increased workload. She urged the Council to fill existing positions, hire additional staff, and bring forward policy -related discussions for Council consideration. Tim Kinsey spoke in support of the City's Alternative Dispute Resolution (ADR) program for Workers' Compensation. He shared his extensive experience representing public agencies and described the ADR program's effectiveness in expediting medical treatment and resolving disputes more efficiently than standard processes. He highlighted that the ADR program allows for faster treatment authorization, streamlined dispute resolution, and quicker decisions on certain cases, helping ensure injured employees receive timely care and return to work more quickly. Nick Burki expressed support for the City's Workers' Compensation employees. He praised the team's performance, noting strong audit results despite limited staffing and outdated resources. He expressed concern about potential outsourcing, emphasizing the value of retaining local control and City Council Minutes of January 27, 2026 Page 3 of 21 maintaining current service levels. He supported a proposed agreement addressing staffing and service needs and urged the Council to move the item forward for public consideration. Rafael Cobian, a representative for the AFSCME, General Unit, spoke in opposition to outsourcing the City's Workers' Compensation program. He cited strong audit results and performance data, emphasizing the effectiveness and cost -efficiency of the City's in-house model. He referenced an independent study recommending continued self -administration with targeted staffing improvements. He urged the Council to invest in the existing program and maintain in-house operations rather than transition to a third -party administrator. John A. Ferrone from Ferrone Law Group, representing the Firefighters Association, spoke in support of enhancing the City's ADR program for workers' compensation. He described the proposal as an innovative, collaborative approach designed to improve efficiency, reduce delays in care, and lower costs, including overtime expenses. He emphasized that streamlining processes and improving access to medical treatment can help employees return to work more quickly while fostering trust and better outcomes. He stated that the approach could serve as a model for other agencies. Dennis Yunk, President of the Anaheim Firefighters Association, expressed his support of the ADR program and workers' compensation. He emphasized the physically demanding nature of firefighting and the importance of timely access to medical care, particularly for orthopedic injuries, cancer, and cardiac conditions. He stated that the proposed measures would streamline treatment, reduce delays, lower costs, and help firefighters return to work more quickly. He urged the Council to approve the resolutions to improve care and outcomes for employees. Jason Barlow, Secretary of the Anaheim Firefighters Association, spoke in support of proposed resolutions related to Workers' Compensation services and the ADR program. Drawing on his experience representing firefighters, he highlighted challenges with the current system and its impact on employees. He stated that similar programs in other agencies have reduced delays and improved outcomes, and he expressed confidence that the proposed measures would enhance care, expedite claims, and provide cost savings. She highlighted the community's role in contributing the holiday festivities by decorating their homes with lights and other decorations. She invited Anaheim Beautiful President Lori Dinwiddie and Miss Anaheim Beautiful Sophia Prudencio to present the winners and provide additional information on the program. Miss Anaheim Beautiful Sophia Prudencio thanked the Mayor and the City Council Members for recognizing the winners. She announced the 2025 Anaheim Beautiful Holiday Lights winners, beginning with the Miss Anaheim Beautiful's Choice Award to Steven Gonzalez and Jennifer Brooks. She presented the winners for each City Council District: the Garcia Candelario family (District 1), the Brand family (District 2), Robert Nelson (District 3), the Loterbauer Teran family (District 4), the Penilla family (District 5), and the Smith family (District 6). She recognized the Ludwig and Comb family as the winners of the outstanding LED display awards, sponsored by Anaheim Public Utilities. She announced that three displays received the Bright and Beautiful Award, including the Stevens family for the award sponsored by Mama Cozza's restaurant, Ray Fryxell for the award sponsored by Apollo Printing and Graphics, and the Boyenger family for the award sponsored by Boydstun Realty & Property Management, Inc. Recognizing David Boyle from Vons for his retirement and for his dedication and work portraying Santa Claus Mayor Aitken recognized David Boyle on his retirement from Vons and for spreading holiday cheer across Anaheim by portraying Santa Claus at community events across Anaheim and Orange County. She shared that he brought the spirit of the season to life with warmth, kindness and authenticity. She noted that he gave his time, heart, and genuine care to bring smiles to countless faces. On behalf of the City, she thanked him for bringing joy to the community and across Orange County and wished him the best in retirement. Mr. Boyle expressed his gratitude for the recognition and shared his joy working at Vons and portraying Santa. He noted his long-standing community involvement and connection to Anaheim. City Council Minutes of January 27, 2026 Page 5 of 21 Recognizing Dr. Ash Hakhamian and his team for their efforts to stabilize and provide care for a critically injured dog Mayor Aitken recognized Dr. Ash Hakhamian, veterinarian and medical director at University Veterinary Center, for his care, compassion, and professionalism for the extraordinary action that saved the life of an innocent dog. She shared that a small, severely neglected dog was abandoned outside the gates of the veterinary center in a disturbing act caught on security cameras. She stated that Dr. Hakhamian and his team responded immediately by providing the dog the urgent care needed to survive and provided a chance to heal and be loved. She thanked the Anaheim Police Department for their swift investigation and arrest in this incident, and for their continued work to ensure accountability. She thanked Dr. Hakhamian and his team for their dedication to animal welfare. Dr. Hakhamian shared his lifelong passion for helping animals. He shared his professional journey to set up his own practice in Anaheim. He highlighted the importance of community support and noted the business's upcoming 10-year anniversary. He thanked the City Council, the Police Department, and the community for the support and recognition. He expressed gratitude or being part of Anaheim ACCEPTANCE OF OTHER RECOGNITIONS To be presented at a later date: Recognizing January 27, 2026, as International Holocaust Remembrance Day Karen Warren, Sisterhood Membership Chair, Board of Directors of Temple Beth Sholom, thanked the City Council for acknowledging and recognizing International Holocaust Remembrance Day. She shared that members of Temple Beth Sholom were in attendance as well as Sarah Schweitz. She shared that she is a trusted member of the community and a Holocaust survivor. She emphasized the importance of remembrance and thanked the Council for its recognition and declaration. At 5:51 p.m., Mayor Aitken called to order the Anaheim Housing Authority, in joint session with the City Council. ADDITIONS/DELETIONS TO THE AGENDAS: None PUBLIC COMMENTS fall acienda items. except public hearing Prior to receipt of public comments, City Clerk Theresa Bass provided an outline of procedures for public comments, notice of translation services, and a brief decorum statement. City Clerk Theresa Bass reported that a total of thirty-four (34) public comments were received electronically prior to 2:00 p.m. [A final total of thirty-eight (38) public comments were received electronically, distributed to the City Council, and made part of the official records]. — See Appendix. Kenneth Batiste expressed concerns about the high cost of living and housing affordability in Anaheim, citing rising home prices and rent levels. He emphasized the need for greater housing stability and protections for residents, including potential rent control measures. He urged the Council to prioritize policies that support and protect residents over special interests. Janis Heckel, Executive Director of the Anaheim Community Foundation, spoke in support of Housing Authority Item No. 1. She shared that the ACF is grateful for the Council's time, consideration, and continued commitment to the residents of Anaheim. She explained that the property located at 883 S. Anaheim Boulevard represents hope, stability, and opportunity, and allows the ACF to establish a permanent home and hub where nonprofit organizations could serve the community. She noted that City Council Minutes of January 27, 2026 Page 6of21 the space would become a space for collaboration, problem -solving, and compassion. She added that approval of the lease would ease the economic burden for nonprofits to focus on helping people. R. Joshua Collins suggested implementing a day fine system similar to other countries. He noted that the City of Los Angeles would be implementing an income -based traffic fine system in 2026. He explained that the traditional methods are burdensome to income -restricted individuals, which could lead to job loss, license suspension, missed payments, and late fees. Paul Hyek recommended a group to assist with securing employment for the homeless population. Mark Richard Daniels expressed concern about current national and global events and their impact on the community. He encouraged the City Council to focus more on local issues such as homelessness and housing affordability. He urged the City Council to use their platform to raise awareness and address issues affecting residents both locally and beyond. Shorlette Knighton thanked the City Council for repairing the Olive Hills tennis courts. She shared the positive impacts the repairs have had on community members and requested future Council consideration to resurface the courts. Jeanine Robbins expressed concerns about homelessness, public safety issues, and alleged misconduct within City government. She raised concerns about staffing levels and working conditions in City departments, as well as transparency and accountability in leadership. She criticized City leadership and called for greater oversight, accountability, and action to address community and organizational concerns. He called for meaningful reform and greater accountability to restore public trust. He requested the immediate release of the body camera footage and the autopsy report. He expressed concerns about policing practices in Anaheim and Orange County. He urged increased community oversight and involvement in law enforcement decisions. Abraham Q spoke in support of the Arzola family and called for transparency and accountability. He requested the release of the unedited body camera footage and identification of the officers involved. He shared the support the community had for the family and the character of Albert Arzola. He urged Police Department reforms and reiterated the requested release of the body camera footage. Nathaniel Lozano shared his support for the Arzola family and expressed his condolences for their loss. He called for accountability and the release of the full unedited body camera footage and audio. Andrew Winger expressed concerns about evacuation safety, traffic planning, and coordination between jurisdictions related to the Festival project. He explained that resident perspectives were not fully considered. He requested that residents be given adequate opportunity to provide input on future agenda items related to the project and emphasized the importance of incorporating detailed local knowledge into decision -making. Melina Martinez emphasized the importance of public transportation in providing access to jobs, education, and essential services, particularly for low-income individuals, students, seniors, and people with disabilities. She expressed concern about long bus wait times and the impacts on transit - dependent riders. She requested that the City Council work with the Orange County Transportation Authority to improve service frequency and reliability to better meet community needs. Matthew Duncan shared his appreciation for the recognition of Dr. Hakhamian and his team. He reported that the City has not trapped a coyote since October 2024 and none have been trapped during 2025. He thanked Dr. Hakhamian for his work. Sergio Pelayo recognized the passing of Bianca Esquivel, who passed away in a traffic fatality. He spoke in support of the family of Albert Arzola. He expressed concern regarding the circumstances of the incident, including medical attention and transparency. He requested accountability over the incident and the need for public disclosure. Christine Ediss called for the release of the full, unedited video footage related to the office -involved shooting on December 6, 2025. She shared that Albert Arzola had recently celebrated his 19tn birthday, worked for the Honda Center, and loved the Anaheim Ducks. She expressed concern about the use of force and the importance of de-escalation. She urged the City Council to release the unedited body camera footage to ensure a fair and transparent investigation to restore public trust. Veronica Mejia expressed her gratitude for adjourning the December 9, 2025 meeting in memory of her daughter Mia. She thanked Council Member Maahs for requesting the adjournment and the installation of 988 signage in public spaces. She thanked the City Council for honoring her memory and their commitment to help save lives. Grace A requested the release of the unedited body camera footage and autopsy report for the officer -involved shooting involving Albert Arzola. She expressed concerns about communications with Council Members. She requested an independent investigation into the shooting. She shared that her family will continue to seek transparency, accountability, and justice. Ariana Avalos, on behalf of the Arzola family, presented statistics and data from the FBI and ACLU database regarding the Anaheim Police Department related to police -involved incidents. She raised concerns about policing practices and their impact on the community. She called for an independent investigation, the release of the full body camera footage, and the officer's information. She emphasized the need for transparency, accountability, and reforms to restore public trust. Leslie Lopez shared the impacts of the December 6, 2025 office -involved shooting on the Arzola family and the community. She expressed concern regarding police training and de-escalation skills. She urged the City Council to initiate an independent investigation into the incident, improve training and de-escalation practices, and ensure accountability. He shared concern about the lack of accountability and recognition of the issues. He urged the City Council to take action to address community concerns. Vance Dizney shared his initiative to open the Disneyland theme park after hours to promote positive community change. He expressed his condolences to the Arzola family. He encouraged City leadership to stay focused on positivity and progress. Rosita Enriquez expressed appreciation for City officials and their service to the community. She expressed her condolences to the Arzola family. She emphasized the importance of giving all community members the opportunity to be heard and acknowledged during public comment. She encouraged stronger and positive relationships between law enforcement and the community. She suggested increased outreach and engagement by police with youth to build trust, understanding, and mutual respect. Wes Jones expressed concern about the current leadership system and the influence of special interests and labor groups. He stated that without campaign reform, the City would continue to encounter the same issues. Mazatl T. Tepehyolotzin acknowledged the Indigenous land of Native American peoples and emphasized cultural identity among Chicano and Mexican communities. He expressed concerns about injustices, including policing practices and their impact on the community. He called for justice for Albert Arzola. He spoke about unequal access to community resources and renaming school mascots associated with colonial history. Jennifer Gies congratulated the City on a successful NAMM show and shared her positive experience attending the event. She urged the City Council to adopt a Sister City with the City of Hebron (AI - Khalil), She shared that the partnership would align with the City's mission to promote cooperation, share heritage, and develop mutually. She shared that the City of Hebron supports the initiative. She reiterated her previous requests to establish a Sister City partnership with Hebron. Vern Nelson requested the release of the unedited camera footage and names for the officers involved in the shooting on December 6, 2025. He commented on the City's leadership and a lack if transparency in City government. He urged the City Council to establish an immigration legal defense fund. He requested clear instructions for police enforcement and interactions with federal immigration officials to protect community members and comply with the law. Council Member Meeks requested that Director of Public Works Rudy Emami speak with Andrew Winger on evacuation modeling and plans. Mayor Aitken noted that the City has a Sister City Commission that evaluates proposals for new partnerships. She shared that she would forward the information to the Commission for their review. Marc Herbert expressed concerns with Housing Authority Agenda Item No. 1, noting that the Housing and Community Development Commission recommended additional review before approval. He noted inequities in police shootings involving Latinos compared to overall shootings in the Resort District. He requested that hotel owners meet with the Police Department to discuss a potential policy He questioned the lack of follow-up on the JL Group report and the lack of subsequent investigations into the allegations in the report. He requested that City Manager Vanderpool be fired. City Council Minutes of January 27, 2026 Page 9 of 21 Juanita Lopez shared that she was the grandmother of Albert Arzola. She shared her grief and questioned the use of force used in the shooting. COUNCIL COMMUNICATIONS: Council Member Kurtz reported that the City has more than 350,000 residents, larger than other metropolitan cities, and a diverse and wide range of residents. She expressed her pride in representing District 4. She added that District 4 includes the most impacted neighborhoods in the City. She reported that the Resort community brought holiday cheer to neighborhoods with the D4 Toy Drive in the Philadelphia/Olive, Guinida Lane, Hermosa Village, Clifton/Philadelphia, the Golden Skies Mobile Home Park, and Spinnaker/Ponderosa neighborhoods. She reported that the toy drive in the Spinnaker/Ponderosa neighborhood was postponed and rescheduled to the next day due to ICE (Immigration and Customs Enforcement) activity and safety concerns for the residents. She thanked Madres Comunidad de Ponderosa for reserving the space for the toy drive and the parents for ensuring the safety of the children while participating in the activities and selecting toys. Council Member Kurtz thanked the hotels and businesses for being good neighbors to the community during Christmas, including the Best Western Plus Anaheim Inn, Desert Palms, Castle Inn & Suites, The Anaheim Hotel, The Pizza Press, Sheraton Park, Karmel Shuttle, Tropicana, Wyndham, Anaheim Majestic Garden, Best Western Plus Pavilions, Best Western Plus Stovall's Inn, Del Sol Inn, Westin, SafeCo Parking, Grand Legacy at the Park, OCHLA, Peacock Suites, Best Western Park Place, JW Marriott, Cartona Inn, Alpine Inn, Anaheim AeroLink, Hotel Indigo, Hyatt House, Courtyard Anaheim, Sonesta Anaheim, Alamo Inn & Suites, Camelot Inn & Suites, Hyatt Place, Parking Company of America, Sonesta ES Suites, Visit Anaheim, ATN, and the Anaheim Community Foundation (ACF). She shared that the hotel employees have shared their pride in helping the community and noted that many employees live in the neighborhoods. She highlighted the owner of SafeCo Parking for reaching out to contribute. She noted that Visit Anaheim was present at each toy distribution and volunteered to help hand out toys. She shared that ACF was the recipient of all the donations and assisted with shopping for toys. Council Member Kurtz thanked City staff for their assistance with the toy drives, particularly Community Services. She noted that Director of Community Services Sjany Larson -Cash supported the efforts and thanked her. She thanked City Manager Jim Vanderpool for coordinating with departments for participation at events and meetings to ensure that issues were addressed. Council Member Maahs acknowledged the community's efforts at the 2nd Annual Community Resource Fair at Katella High School. She thanked Council Member Kurtz for inviting her to participate. She shared that many organizations were invited to connect students and families to resources. She acknowledged the passing of Alex Pretti in Minnesota. She reported ICE presence around Katella High School. She highlighted the community's involvement in protecting students. Council Member Maahs credited the school staff and City staff for jumping into action. She acknowledged the impact that immigration enforcement measures have had on the community and on City staff. Council Member Rubalcava acknowledged the family of Albert Arzola and offered her thoughts and prayers to the family. She recognized the City's efforts and changes since 2012 on officer training and the conduct of independent investigations. She shared that the Orange County District Attorney's Office and the Office of Independent Review are involved with investigations. She added that the Police Review Board was designed and implemented following 2012 and stated that the incident is not taken lightly by the dais and affirmed a commitment to due process. Council Member Rubalcava displayed photos of a vigil held in response to the ongoing ICE enforcement. She recognized the community leaders who organized the event, including Yesenia Rojas, and Mayor Pro Tern Leon and Council Member Maahs, for their attendance. She noted that the City Council quickly acted following City Council Minutes of January 27, 2026 Page 10 of 21 the first reports of ICE enforcement in the City, including the creation of Anaheim Contigo. She emphasized that the Police Department serves the City and community and does not assist with federal immigration enforcement. She also acknowledged the passing of Alex Pretti in Minnesota. Council Member Rubalcava shared that during her tenure in office, she has noticed clear progress under City Manager Jim Vanderpool's leadership. She reported that the City has made measurable advances in addressing homelessness, the recruitment for a highly -qualified Chief of Police, Disneyland Forward, OCVIBE, responsible steps to balance the budget and pay off bonds, expanded library hours, strengthened relationships with non -profits, established a Housing Trust, and the Strategic Plan. She shared that the accomplishments reflect steady and competent leadership and display a commitment to the community. She expressed her continued support for City Manager Vanderpool and expressed her gratitude for City Manager Vanderpool's commitment to the City. Mayor Pro Tern Leon acknowledged the ongoing federal immigration enforcement efforts and the impacts on the community. He shared that he continues to look forward to working with residents, stakeholders, and his Council colleagues to move forward with compassion in the community [ provided his comments in Spanish]. Mayor Pro Tern Leon reported that he partnered with Frank Garcia and La Casa Garcia for a toy distribution at Servite High School. He shared that partnerships included United Across Borders, Neutral Ground, and volunteers across the community. He shared that those moments serve as a reminder of the unity and strength in the community. Mayor Pro Tem Leon thanked Chief Cid for visiting a neighborhood in District 2 to participate in the Rosca de Reyes tradition. He thanked all of the neighbors who attended and the neighborhood leaders for organizing the event. He highlighted the Orange County Clerk -Recorder's Mobile Passport Clinic at Magnolia High School. He shared that many families were assisted in a safe space and shared that his office would be working with the County's office to schedule more in the community. Mayor Pro Tern Leon announced the grand re -opening of Anaheim High School's Cook Auditorium. He highlighted the Anaheim Union High School District's dedication to the performing arts and to students. He thanked Congressman Lou Correa for securing funding for the project. He highlighted the NAMM show held at the Convention Center. He noted that the show gathers tens of thousands of attendees and provides an economic boost to the City. He thanked the Convention Center staff who worked the event and contributed to the successful event. Mayor Pro Tern Leon announced that registration is open for the third annual Youth Leadership Summit & Expo event on Saturday, March V1. He announced that students can learn about leadership, advocacy, and community involvement opportunities. He requested to adjourn the meeting in memory of Joel Esparza. He shared that Mr. Esparza leaves behind his wife, four children, and four grandchildren, who brought him immeasurable pride and joy. He added that Mr. Esparza was dedicated to helping others through organizations he led, including the Brown Descents Car Club and individual acts of kindness. He shared that he touched many lives and helped people find their footing after their most difficult moments. Council Member Balius echoed Council Member Rubalcava's comments regarding City Manager Jim Vanderpool. He shared that during his time, he recognizes the stability that City Manager Vanderpool provides to Anaheim. Council Member Balius highlighted Anaheim Fire and Rescue's Engine 1 following his ride -along. He shared that he witnessed great professionalism by the Fire Department during a house fire incident. He highlighted their teamwork and their care for residents. Mayor Aitken thanked Chief Cid for attending introduction meetings with the community. She shared that Chief Cid has committed to leading with integrity and addressing issues with transparency. She acknowledged the community's concerns. She encouraged the public to interact with officers and the Chief at community events and meetings. She highlighted two upcoming meetings with the Chief and thanked him for being available to answer the community's questions. Mayor Aitken reported that she, Council Member Balius, Council Member Kurtz, and the City Manager visited Sacramento to discuss the state of the Surplus Land Act with elected officials. She addressed concerns about City Council Minutes of January 27, 2026 Page 11 of 21 transparency on Angel Stadium and noted that monthly updates are provided during the City Manager's Update. She shared that she would be requesting a Master Site Plan for the area. She explained that the outcome of the property would be considered with a lot of community input and benefits. CITY MANAGER'S UPDATE: City Manager Jim Vanderpool announced that Anaheim's Community Open House has returned. He invited residents to attend an upcoming open house in their District from 5 p.m. to 7 p.m. He explained that the open houses are not formal presentations and do not require attendees to arrive on time. He shared that topics at the meetings would include district -specific issues and Citywide interests. He explained that the open houses offer opportunities to connect with City leaders and staff one-on-one to ask questions and discuss neighborhood priorities. He reported that additional information could be found on the City's social media and website. City Manager Vanderpool reported that the NAMM Show drew more than 50,000 music industry professionals, artists and more to Anaheim the week prior. He shared that the NAMM show is the City's largest and most significant, bringing people from around the world to stay in hotel rooms and enjoy all Anaheim has to offer. He added that the visitors in turn, provide funding for all we do as a City. He congratulated the Anaheim Convention Center and the City's hospitality partners for another great NAMM. Finance Director Deborah Moreno reported that Assembly Bill (AB) 516 and AB 1600 require that the Annual Development Impact Fee report be received and filed by the legislative body. She stated that a development impact fee is a one-time payment imposed on a property developer that is intended to offset the financial impact that new development places on public infrastructure, including transportation, sewers, storm drains, parks, libraries, and police and fire facilities and equipment. She shared that California agencies are required to report annually on the Development Impact Fees collected throughout the fiscal year and their uses. She stated that the annual report includes a description, fee amount, beginning and ending fund balances, the total fees collected, and the interest earned. She added that the report includes identification of public improvements on which the fees were used and the amount of expenditures on each improvement, including the total percentage of improvement costs that were funded by fees and the expected start date for construction on incomplete fee -funded improvements for which sufficient funds have been collected. She reported that every five years, agencies must identify the purpose of each fee, demonstrate a reasonable relationship between the fee and the purpose for which it's charged, and provide updates on the funding and status of incomplete projects. She shared that the report must be made available 100 days after the last day of the fiscal year, and presented to the governing body at the next regularly scheduled meeting not less than 15 days after making it available. She stated that the report was made available on the City's website and at the City Clerk's public counter on December 30, 2025. She reported that staff are working on updates to the existing Development Impact Fees based on projected development through 2045 and the anticipated impact on City infrastructure. She announced that the study and recommended updates would be presented to the City Council in March or April. DISCUSSION: In response to Council Member Balius, Director Moreno explained that the park -in -lieu fees were last presented in 2018. She added that the fees are presented by individual departments and the Finance Department facilitates the process. Council Member Balius inquired about the process for updating development -related fees. He requested clarification on when the last fee evaluation was presented. City Attorney Fabela acknowledged concerns about inconsistencies in the Municipal Code regarding annual reviews of the development impact fees. He emphasized that the legal issue is whether there is proportionality and a nexus. Director of Community Services Sjany Larson -Cash explained that the development fees are determined by a formula through the Quimby Act, which includes land valuation and park acreage standards per 1,000 residents. She noted that in previous years, there was no interest in increasing development impact fees. She explained that increasing land valuations without raising corresponding fees could create a financial deficit for the City, as it would increase reimbursement costs owed to developers who build park land. In response to Council Member Balius, Director Moreno explained that the $213 million would be grant revenues which fund park improvements. City Council Minutes of January 27, 2026 Page 14 of 21 Council Member Balius requested clarification on whether $8 million was contributed from the DisneylandForward item. Director Larson -Cash confirmed the contribution was from Disneyland Forward, which the City received in June. In response to Council Member Balius, Director Larson -Cash explained that the remaining balance of the reimbursements was received from grant funds. She added that the City contributes the money to projects first and the grant funds reimburse the City. Council Member Balius provided Little Pine Park as an example of a park funded entirely by development impact fees. He requested additional information on how grant funding and any offsets or reimbursements are reflected in the Development Impact Fee Report. Director Larson -Cash clarified that the report represents a snapshot in time, showing impact fees used upfront to fund projects. She explained that grant funds are received as reimbursements which may not be reflected in the initial accounting shown in the report. In response to Council Member Balius, Director Larson -Cash confirmed that reimbursements following the end of the fiscal year would be included in the following fiscal year report. In response to Council Member Balius, Director Moreno explained that reporting requirements are mandated. She added that the requirements are in their second year of implementation, and additional information, based on the Council's feedback, would be considered for the following year. Council Member Balius highlighted the importance of including the information for clarification on the performance of impact fees. He requested clarification on new projects for 2024. Budget Supervisor D'Anne Lee explained that the fees do not include associated specific project needs, resulting in no identified projects for 2024. She noted that the previous report identified the Platinum Triangle Fire Station because the needs had been identified. Purchasing Agent Ed Segura reported that the recommended action is a purchase of four Medix ambulances from Republic EVS, in the amount of $1,027,983.92, which would be located throughout the City. He explained that the ambulances would provide dedicated resources for areas previously assigned. He stated that there is a 20-month lead time on the build -out and receipt of the vehicles. He reported that Republic EVS is a local authorized Medix dealer. He added that the purchase would be made using the Houston -Galveston Area Council Cooperative Purchasing Agreement. City Council Minutes of January 27, 2026 Page 15 of 21 DISCUSSION: In response to Mayor Pro Tem Leon, Fire Chief Pat Russell explained the delivery time is typically 20 to 24 months. He added it could be sooner if other departments decline units that meet the City's specifications. Mayor Pro Tem Leon questioned if the item was requested now due to expected delivery delays or a current urgent need. Chief Russell reported that the new ambulances would replace those in service. He added that the current ambulances would go into reserve. He noted that with additional units planned for service at Fire Station 12 and the APRU unit, without additional replacements, there could be a lack of sufficient reserve ambulances when needed. Mayor Pro Tem Leon requested additional information on the City's ambulance program. Chief Russell explained that the ambulance services were transitioned in-house to the Fire Department, which provided complete control over the City's EMS system. He explained that with a contracted ambulance company, the City would administer the EMS program with no control over how many ambulances were in service. He highlighted the return on investment to the General Fund and the benefit of controlling the service levels. He noted that the program also provides an outstanding hiring pool for the City. In response to Mayor Pro Tem Leon, Chief Russell shared that many individuals have participated as Explorers and in the Ambulance Program to become full-time firefighters with the City. He highlighted the Department's recruitment efforts in the community with EMT scholarships for eligibility as Ambulance Operators and assistance with the Fire Academy. He shared that five or six firefighters were Ambulance Operators and a few were Anaheim residents. Council Member Kurtz expressed her support for the item. She requested additional clarification on the fourth ambulance with special outfitting. Chief Russell reported that the unit would be part of the new APRU program, which would include a Captain and Nurse Practitioner. He explained that the ambulance would include an exam chair instead of a gurney. He added that a gurney could be included if the ambulance is required for service. Council Member Kurtz thanked Chief Russell for ensuring the City's needs are addressed and reiterated her support for the item. DISCUSSION: In response to Council Member Kurtz, Director of Public Works Rudy Emami confirmed that the services would not be used to monitor employee performance. He stated that the services are for diagnostic and predictive maintenance for vehicles. DEVELOPMENT AGREEMENT NO. 2005-00008 AGR-3750.A ADDENDUM NO. 4 TO PLATINUM TRIANGLE EXPANSION PROJECT MITIGATION MONITORING PLAN NO. 321 APPLICANT: PT Metro, LLC and Joey Caucas; 20 Enterprise, Suite #125, Aliso Viejo, CA 92656 PROJECT LOCATION: The property is located at 1404 East Katella Avenue. REQUEST: Pursuant to Resolution No. 82R-565, governing the consideration of development agreements, the City Council will consider establishing new development timeframes for PT Metro, LLC to comply with Development Agreement No. 2005-00008 for the A -Town Project. ENVIRONMENTAL DETERMINATION: The City Council will consider whether Addendum No. 4 to the Platinum Triangle Expansion Project, along with Mitigation Monitoring Plan No. 321, together with other previously approved environmental documentation, serves as the appropriate environmental documentation for the request. RESOLUTION NO. 2026-004 _ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM establishing a performance time schedule for the tenth anniversary date as set forth in the Amended and Restated Development Agreement No. 2005-00008 between the City of Anaheim and PT Metro, LLC and determine Subsequent Environmental Impact Report No. 339 for the revised Platinum Triangle Expansion Project, along with Mitigation Monitoring Plan No. 321, are the appropriate environmental documentation for this request. Planning and Building Director Heather Allen reported that the request is to establish a new performance timeline for Lennar's A -Town development. She stated that at the December 16, 2025 meeting, the City Council determined that the Developer was not in compliance with the terms and conditions of the Revised Agreement for the 2025 review period and directed staff to provide notice to the Developer of the Council's intent to establish new development timeframes. She reported that in October 2005, the City Council approved a Development Agreement to govern development of the A - Town Metro project. She added that in October 2015, the Council approved a Revised Agreement which changed the project name to "A -Town" and allowed the development of between 1,400 and 1,746 residential units, a range of commercial area between 38,000 and 50,000 square feet, and two public parks. She stated that in May 2018, the Council approved an amendment to modify performance milestones to be completed by the year of 2020, 2022, 2025, and 2030, with completion of each milestone granting the next corresponding extension. Director Allen reported that the Developer has completed the milestones for 2020 and 2022, authorizing extensions of the Revised Agreement term through October 2025. She stated that the first two milestones of the project included completion of 638 residential units, surrounding streets, and associated infrastructure. She shared that Aloe Greens Park and the Linear Park have also been completed and dedicated to the City. She added that the next milestone in the Development Agreement requires construction of an additional 462 residential units. She announced that currently 330 units are under construction, leaving 132 units outstanding to meet this milestone. She reported that Final Site Plans, including the outstanding units, were approved by the Planning Commission in 2022 and early 2023; however, due to challenges in financing large-scale mixed -use podium projects, the property owner has not started construction on the remaining 132 units, thereby not completing the milestone that was due in October of 2025. City Council Minutes of January 27, 2026 Page 18 of 21 DISCUSSION: Mayor Aitken requested clarification on the areas not completed for development by Fall 2025. Director Allen clarified that areas B, C, and D of the property have not commenced construction and areas E and F have begun construction. She reported that the Developer is requesting to extend the October 2025 milestone approximately nine months, moving the deadline from October 20, 2025 to July 31, 2026. She stated that the Developer has indicated their intent to apply for amendments to the Revised Agreement and Master Site Plan for future consideration by the Planning Commission and City Council by July 31. She added that the request would include a new timeline for completing Development Area B, including the future grocery store, and changes to Development Areas C and D from mixed -use podium buildings to townhomes. She reported that staff believes that the additional time request is reasonable given current market conditions and will provide the Developer with additional time to submit a request to amend the Revised Agreement and Master Site Plan and return to City Council for review later this year following consideration by the Planning Commission. DISCUSSION: In response to Mayor Aitken, Director Allen explained that within the six-month extension, the developer would formally request an amendment to the Development Agreement to reset the future timeframes. She noted that upcoming deadlines, the October 2025 deadline and remaining work through 2030, would be reevaluated as part of the amendment. She added that the grocery store provision would be included in the revised agreement. She clarified that any amendment would require review and approval by both the Planning Commission and City Council. She added that revisions to the Master Site Plan are anticipated, including potential changes to unit types in certain areas, which would also require the same approval process. Mayor Aitken requested clarification on the timeline for the Site Plan and the location for the grocery store. Greg Powers with Jackson Tidus Law Firm, Special Land Counsel for PT Metro, confirmed the grocery store would be located on Parcel B. He added that Areas G, A, and H have been completed with E and F currently under construction. He explained that the developer is 132 units short of meeting the development milestone. He noted that the pandemic contributed to the lack of construction. City Attorney Fabela advised that questions or comments should be addressed during that allotted time rather than interrupting the discussion. Mayor Aitken thanked the developer for the grocery store commitment. In response to Council Member Maahs, Mr. Powers stated that securing a high -quality grocer for the project is a top priority, following discussions with staff. He confirmed that Development Area B is designated for the grocery store and no changes are proposed to its product type or master plan. Mr. Vanderpool led the City through a fair and transparent process to select a new Chief with involvement from the community and key stakeholders, and hit a home run with the selection of Chief Cid. Since Mr. Vanderpool assumed the position of City Manager in Anaheim in September of 2020, he has led the City forward, subject to the policy direction of the Council, across a large number of successful and consequential items for the residents and businesses of our community. 1. Pandemic Recovery— He saw the City through the second half of the pandemic and the recovery and reopening of the City as we emerged from the COVID-19 pandemic. This included rental assistance programs for workers furloughed in our tourism and other businesses, distribution of food aid, and the gradual and now complete re -opening of our number one economic engine —the Anaheim Resort. The pandemic was particularly difficult for a tourist -oriented city like Anaheim, and he led us through this challenging time well. 2. Fiscal Management in Difficult Times — Leading a City dependent on tourism -based revenue through and out of the pandemic was a huge challenge, but Mr. Vanderpool has helped stabilize our finances with federal and state assistance and getting the Resort re -opened. While the City faces some fiscal challenges still, the hope ahead due to the imminent retirement of the LPMR bonds also gives the City an opportunity to reinvest in neighborhood services, and Mr. Vanderpool's strong fiscal management in challenging times has given us that opportunity. 3. Entitlement of OCVibe — On his watch, the City has seen major investment around the Honda Center with the entitlement of OCVibe. This housing and entertainment district around our Arena will create anew downtown for Orange County that will create jobs, housing, tax revenue, and economic activity for our City. 4. Disneyland Forward Approval —The final approval of anew round of major Disney investment in our city will also create significant new opportunities for growth in employment and economic revitalization in our Resort. 5. Major Progress on Beach Blvd. —As he did when he was City Manager of Buena Park before coming to Anaheim, Mr. Vanderpool has overseen a tremendous wave of progress in West Anaheim centered around Beach Blvd. The "Rebuild Beach" program has seen the City take over the Right of Way from Caltrans, median improvements, and most importantly, the closing of several old hotels that were hotbeds of crime and prostitution and are now being redeveloped into affordable housing. We're also excited to see development beginning at 39 Commons after decades of delay. 6. Major progress on Housing — One of the biggest challenges in all Southern California cities is housing, especially affordable and workforce housing, and Mr. Vanderpool has been a Leader on this critical issue as well. While other cities have struggled, Anaheim has a state - approved Housing Element compliant with our RHNA numbers while several other cities have struggled. And since the fall of 2020, Anaheim has entitled many new housing units, including a robust mix of affordable, senior, workforce, market rate, and permanent supportive housing options. Anaheim also established the Anaheim Local Housing Trust Fund with funding from our theme parka nd hotel partners to help with rental assistance and first-time homebuyer programs. 7. Significant improvement on Homelessness — In the last five years, Anaheim has made significant improvements in helping homeless people get out of our streets, parks, and public places, and into shelters with wrap -around services. No insurance company will ensure me so I had to get coverage through the CA Fair Plan which is not ideal. While living here, I have had to evacuate at least 3 times. During those evacuations my wife, son and I experienced extremely long delays leaving the danger area. Cars were stuck and not moving on Serrano and surrounding major streets trying to get away with their precious possessions. During all the fires in this area, I have never seen a police coordinated efficient evacuation. the entire Anaheim Hills area is at risk of catching on fire. Not only because of the proximity to brush but from cinders flying all around. Additionally during the last few years, the housing developments in Riverside has increase the traffic through Anaheim Hills as drivers try to cut through Serrano, Weir Canyon and E Santa Ana Canyon Rd to get to the 91 Frwy. Adding more residents to this area would expose those residents to unnecessary danger and increasing the danger for current residents. Furthermore, those new residents will encounter financial challenges finding insurance. You will also increase the burden on the local schools. Schools that are also in danger of fires. I would suggest that if you are trying to address the housing problem, including the low income housing shortage, you look into what other cities have done successfully. Redevelop downtown Santa Ana, Anaheim and other downtown areas with affordable apartments with businesses on the first floors. Similar to the developments done near Angels Stadium but not as expensive. I am requesting that you do not approve this development for safety, emirormental and traffic concems. We do not want to be in a Pacific Palisades or Altadena situation because of this unnecessary development. The FEIR fails to evaluate compound scenarios involving congestion plus emergency response or evacuation. CEQA requires evaluation of combined foreseeable conditions; this segmentation understates risk. IV. Inadequate Cumulative Traffic Impact Analysis The FEIR fails to meaningfully analyze cumulative impacts from reasonably foreseeable nearby development and commercial intensification. Statements that such impacts are outside the scope or addressed later do not satisfy CEQA's cumulative impact requirements, particularly given limited egress routes in Anaheim Hills. V. Unreasonable Reliance on Generic Trip Generation Assumptions The Traffic Impact Analysis relies on generic ITE trip rates without adequate adjustment for local conditions, vehicle dependency, event traffic, and emergency surges. CEQA requires reasoned judgment, not mechanical reliance on generalized averages. VI. Insufficient and Non -Enforceable Traffic Mitigation Mitigation measures rely on signal timing, signage, and future design review without enforceable performance standards or physical improvements.
