1965-015RESOLUTION NO. 65R -15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 64 -65 -41 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council as to a portion of said property only, and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission, the City Council did fix the 5th day of January, 1965, as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in a different zone or zones; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that Parcels One and Three, of the prop- erty hereinafter described should be excluded from the zone or zones in which they are now situated and incorporated in the zone or zones as hereinafter set forth; and that Parcel 2 of said property should remain in the zone in which it is now incorporated. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that Parcels One and Three of the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 64 -65 -41 PARCEL ONE: That portion of Lots 2 and 3 of the Stockwell Subdivision in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, per Map recorded in Book 6, page 10 of Miscellaneous Maps, records of Orange County, California, lying East of the Easterly right of way line of the Atchison, Topeka Santa Fe Railway's 100 foot right of way. Excepting therefrom that portion of said Lot 2 conveyed to the State of California by deed recorded September 7, 1956 in Book 3636, page 340 of Official Records. Also excepting that portion of said Lots 2 and 3 lying East of the Northwesterly line of that parcel of land conveyed to Orange County Flood Control District, being a portion of Parcel No. B1- 1209.01 described in deed recorded March 9, 1961 in Book 5651, page 219 of Official Records. PARCEL TWO: Lot Four (4) of the Stockwell Subdivision in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, as shown on a Map recorded in Book 6, page 10 of Miscellaneous Maps, records of Orange County, California. Excepting that portion described as Parcel 1 in deed recorded August 1, 1960 in Book 5355, page 318 of Official Records of Orange County, California. Also excepting that portion lying Easterly of the Westerly line of that parcel of land conveyed to Orange County Flood Control District, being a portion of Parcel No. B1- 1290.01 described in deed recorded March 9, 1961 in Book 5651, page 219 of Official Records. Also excepting that portion lying Westerly of the Easterly right of way line of the Atchison, Topeka Santa Fe Railway's 100 foot right of way. PARCEL THREE: A Lot Six and the South 66 feet of Lot Five of the Stockwell Subdivision as shown on a Map recorded in Book 6, page 10 of Miscellaneous Maps, records of Orange County, California. Excepting therefrom that portion lying West of the East right of way line of the Atchison, Topeka Santa Fe Railroad Com- pany. Also excepting therefrom the Easterly 30 feet lying within the right of way of East Street. B That portion of the Southwest quarter of Section 2, and the Southeast quarter of Section 3, Townhip 4 South, Range 10 West, S.B.B. M., described as follows: Beginning at the Southeast corner of Lot Six of Stockwell Subdivision, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 6, page 10 of Miscellaneous Maps, records of said Orange County; thence Northerly along -2- the Easterly line of said LotSix (6) to the intersection with the Southwesterly right of way line of East Street, 80.00 feet in width; thence Southeasterly along the Southwesterly right of way line of said East Street to the intersection with the Northerly right of way line of La Palma Avenue, 60.00 feet in width; thence Westerly along the Northerly right of way line of said La Palma Avenue to the intersection with the Northeasterly right of way line of the A.T. S.F.R.R. 100 feet in width; thence Northwesterly along the Northeasterly right of way line of said Railroad to the intersection with the South line of Lot Six (6) of said Stockwell Subdivision; thence Easterly along said South line to the point of beginning. be excluded from M- 1,LIGHT INDUSTRIAL and P -L, PARKING -LAND- SCAPING ZONES and incorporated in the following zones: That Parcel One be changed to and incorporated in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE; and That Parcel Three be changed to and incorporated in R -A, AGRICULTURAL ZONE. BE IT FURTHER RESOLVED that Parcel Two of the real property hereinbefore described shall remain in the M -1, Light Industrial Zone in which it is now incorporated, and that the reclassification to R -3, Multiple Family Residential Zone,be, and the same is hereby denied, as recommended by the City Plan- ning Commission. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Ana- heim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
