64-956RESOLUTION NO, 64R -956 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassifiction Proceed ings No. 64 -65 -55 to consider =n amendment to Title 18 3lie77a eim un cipa Code rel ting to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its st and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at s =id herring, and a recommendation that the pro posed amendment be adopted by the City Council nd that a certain zone or zones_ be changed 's hereinafter set forth; and WHEREAS, upon receipt of s id resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 15th day of December 19 6 4 as the time, and the City Council Chaco ers in t e City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim MunicipaI Code, and the exclusion of said property, herein fter described, from the zone or zones in which it is now situ ='ted and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the m-nner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed fo? said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein n oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended :'nd that the following described property, situated in the City of Anaheim, County of Orange, St te of California, to wit: The Northwesterly 120 feet of that portion of Lot 26, of Anaheim Extension as shown on a map of survey made by Wm. Hamel and filed for record in the office of the County Recorder of Los Angeles County, California, described as follows: Beginning at the Southeast corner of said Lot 26; thence Northerly along the Easterly line of said lot, a distance of 503.19 feet, more or less, to the Southeasterly corner of that certain tract of land conveyed by Rollin R. Rees, et ux., to 0. A. Mullinix, by deed recorded January 25, 1924, in Book 506, page 256, Deeds, thence Westerly along the Southerly line of the land so conveyed to Mullinix, a distance of 612.49 feet, more or less, to a point in the Westerly line of said Lot 26, which point is distant 331.89 feet Northerly from the Southwesterly corner of said Lot 26; thence Southerly along the Westerly line of said Lot 26, a distance of 331.89 feet to the South- westerly corner thereof; thence Easterly along the Southerly line of said lot, a distance of 633.60 feet to the point of beginning. EXCEPT the Southwesterly 227.22 feet, measured from the center line of Lemon Street. be excluded from C -1, NEIGHBORHOOD COMMERCIAL ZONE, and incorpo- rated in C -3, HEAVY COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Anaheim Boulevard, for street widening purposes. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Anaheim Boulevard, for street lighting purposes. 3. That the owners of subject property shall pay to the City of Anaheim the sum of per front foot along Anaheim Boulevard, for tree planting purposes. 4. That sidewalks and driveways shall be installed along Anaheim Boulevard as required by the City Engineer, and in accordance with standard plans and specifications on file in the Office of the City Engineer; and that said sidewalks and driveways shall be installed prior to final building inspection. 5. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. -2- 7. That all air conditioning facilities shall be properly shielded from view from abutting streets. 8. That Conditions Nos. 1, 2 and 3 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. THE FOREGOING RESOLUTION is approved and signed by me this 22nd day of December, 1964. ATTEST: 6. That subject property shall be developed sub- stantially in accordance with plans and specifi- cations on file with the City of Anaheim, marked "Exhibits Nos. 1, 2, 3 and 4"; provided, however, that the easterly six feet of subject property shall be developed and maintained as a P -L, Parking Landscaping Zone.
