64-887RESOLUTION NO. 64R -887 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 636. WHEREAS, the City Planning Commission of the City of Anaheim did initiate and propose the granting of a Conditional Use Permit to establish an existing motel as a conforming use in a C -1, Neighborhood Commercial Zone, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of the Southwest quarter of the Southwest quarter of Section 8, in Township 4 South, Range 10 West, in the Rancho Los Coyotes, as shown on a map thereof recorded in Book 51, page 7, et seq., Mis- cellaneous Maps, records of said Orange County, described as follows: Beginning at a point in the South line of said South- west quarter of the Southwest quarter distant thereon 296 feet West of the Southeast corner of said South- west quarter of the Southwest quarter, said point being also the Southwest corner of the land conveyed to Fred C. Piepenbrink and wife, by deed recorded August 23, 1946, in Book 1432, page 236, Official Records, in the office of the County Recorder of said Orange County, and running thence Northerly along the Westerly line of said land conveyed to Piepenbrink, 352 feet to an angle point therein; thence Westerly along the line of said land conveyed to Piepenbrink, 96 feet to the Westerly line of the land conveyed to C. J. Webber and wife, by deed re- corded May 8, 1928, in Book 160, page 138, Official Records, in the office of the County Recorder of said Orange County; thence Southerly along the Westerly line of said land conveyed to Webber, 352 feet to the South- westerly corner thereof; thence Easterly 96 feet to the point of beginning; EXCEPTING THEREFROM the South 40 feet thereof, as conveyed to the state of California, in deed recorded August 2, 1955, in Book 3159, page 92, Official Records, in the office of the County Recorder of said Orange County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on October 26, 1964, notices of which said public hearing were duly given as required by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 1391, Series 1964-65, granting Conditional Use Permit No. 636; and -1- WHEREAS, there fter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to-review the action of the City P1 nning Commission in granting said Conditional Use Permit and did thereupon fix the 1st day of 19 64 as the time and the Council Chamber in the ity Hall of the City of An_heim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by 1. =1w nd the provisions of Title 18, Chapter 18.76 of the An heim Municipal Code; and WHEREAS, .at the time ;.nd place fixed for said public hearing, the City Council did duly hold and conduct 'such: hear- ing acid did give 11 persons interested therein an opportunity. to be heard 4 did receive evidence and reports; 'nd WHEREAS, the City Council finds, after careful conside- ra,ti of the recommend tions of the City Planning Commission and all evidence and reports offered at said hearing, that 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the An heim Municipal Code. 2. The proposed use will not adversely affect the adjoining lnd uses and the growth and development of the area in which it is proposed to be loc ted. 3. The size and shape of the site proposed for the use is adequate to allow, the fullAsvelopment of the proposed, use in a mannernotdetripental to the p rticul r area nor to the peace, health, safety and general° welfare. The traffic generated by the proposed use will not impose an undue burden upon t..streets and high way designed and improved to carry the tr:: ffic in the rea. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welf.re of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission granting said Conditional Use Permit be, and the s me is hereby sustained and that Conditional U Permit No. 636 be, and the same is hereby, granted permitting the establishment and operation of an existing motel as a conforming use in a C -1, Neighborhood Commercial Zone, on the property hereinbefore described. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and. regulations.
