A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF A LETTER AGREEMENT BETWEEN
THE CITY AND THE ATCHISON, TOPEKA AND SANTA
FE RAILWAY COMPANY SUPPLEMENTING AND MODIFY-
ING CERTAIN CONTRACTS BETWEEN THE CITY AND
SAID RAILWAY COMPANY DATED JUNE 9 AND AUGUST
7, 1962 IN REGARD TO CROSSINGS AT ANAHEIM
ROAD AND LA PALMA AVENUE.
WHEREAS, under the terms of contracts entered into
between the City of Anaheim and The Atchison, Topeka and
Santa Fe Railway Company on June 19, 1962, covering the exten-
sion of Anaheim Road across said Railway Company's right of
way and track as a public grade crossing, and on August 7, 1962,
covering tree improvement and widening of La Palma Avenue across
said Railway Company's right of way and track, The Atchison,
Topeka and Santa Fe Railway Company performed certain work
at the City's cost, including installation of four flashing
light signals, two at side road location and two within median
strips, one on each side of the track, at each of the above
mentioned crossings; and
WHEREAS, the Public Utilities Commission has requested
that bells be installed on the two median mounted flashing
light signals at both of the above locations; and
WHEREAS, the City and said Railway Company desire to
supplement and modify the above mentioned agreements to the
extent of adding bells, at City's cost, to the four median
located flashing light signals; and
WHEREAS, The Atchison, Topeka and Santa Fe Railway
Company has tendered to the City a letter agreement, dated
November 5, 1964, to be made and entered into between said
Railway Company and the City supplementing and modifying said
above mentioned agreements as above outlined, which letter
agreement the City Council finds would be for the benefit and
best interest of the City and should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the letter agreement dated November
5, 1964, this day tendered to the City Council to be made and
entered into between the City of Anaheim and The Atchison,
Topeka and Santa Fe Railway Company, supplementing and modify-
ing those certain contracts entered into on June 19, 1962 and
August 7, 1962 between the City and said Railway Company, to
the extent of adding bells, at the City's cost, to the four
median located flashing light signals installed in accordance
with the above mentioned contracts, be and the same is hereby
approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute said letter agree-
ment for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me the 1st day of December 1964.
