64-859RESOLUTION NO, 64R -859 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 5 to consider :n amendment to Title 18 he Ana eim unici.pa Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence ,=nd reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly dopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, end a recommendation that the pro posed amendment be adopted by the City Council and th t certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 24s11 day of November 1964 =s the time, and the City Council Cha mbers i,r�aEFe Cit 1atl of the City of Anaheim as the place for public hearing upon said proposed mendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, herein:fter described, from the zone or zones in which it is now situ ted and the incorporation thereof in the zone or zones hereinafter set forth, and did giv: notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed foe 'said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, a:.d did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- r 64 -65 -53 All that portion of Lot 3 of Helen sion of a portion of the West half ship 4 South, Range 10 West, S.B.B map recorded in book 442, page 158 of Los Angeles County, California, and Lynch's Subdivi- of Section 16, Town- M., as shown on a of Deeds, records described as follows: The Northeast quarter of the Northwest quarter of the Northwest quarter of Section 16, Township 4 South, Range 10 West, S.B.B. M. Excepting therefrom the following: Beginning at a point 324.46 feet West of the Northeast corner of the Northeast quarter of the Northwest quarter of the Northwest quarter of Section 16, Township 4 South, Range 10 West, S.B.B. M. thence South 661.49 feet to the South line of said North- east quarter; thence West along said South line 335.57 feet to the West line of said Northeast quarter; thence North along said West line 662.05 feet to the North line of said Northeast quarter; thence East along said North line 335.71 feet to the place of beginning. Also excepting therefrom the following parcels of land: Parcel A. That portion of the Northwest quarter of the Northwest quarter of Section 16, Township 4 South, Range 10 West, also being that portion of Lot 3 of the Helen and Lynch's Addition to Anaheim, as shown on a map recorded in book 442, page 158 of Deeds, records of Los Angeles County, California, described as follows: Beginning at the Northeast corner of the Northeast corner of the Northwest quarter of the Northwest quarter of said Section; thence South 89 08' 42" West along the North line of said Section, 324.46 feet; thence South 0 51' 18" East 38.37 feet; thence North 87 35' 00" East 324.35 feet to the East line of said Northwest quarter of the Northwest quarter of said Section; thence North 0 24' 59" West along said West line, 30.01 feet to the point of beginning. Parcel B. That portion of said Section described as follows: Beginning at a point in the South line of Parcel A above, said point being Westerly along said line 40.01 feet from the East line of said Northwest quarter of the Northwest quarter; thence Easterly 40.01 feet to said East line; thence South 0 24' 59" East along said East line, 20.70 feet; thence Westerly at right angles to said East line 20.01 feet; thence Northwesterly in a direct line to the point of beginning, as described in the deed to the State of California, re- corded October 23, 1956 in book 3686, page 35 of Official Records. be excluded from R -A, RESIDENTIAL AGRICULTURAL ZONE, and in- corporated in C -3, HEAVY COMMERCIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Loara Street for -2- street widening purposes, including a 15 -foot radius corner return. 2. (a) That all engineering requirements of the City of Anaheim along Lincoln Avenue and Loara Street, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue and Loara Street for street lighting purposes. 4. That the owner of subject property shall pay to the City of Anaheim the sum of 15Q per front foot along Lincoln Avenue and Loara Street for tree planting purposes. 5. That trash storage areas shall be provided in accord- ance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 6. That the 35 -foot setback established by a resolution of the City Council shall be observed in the develop- ment of the property; and, further, that plans of development shall be subject to approval of the City Council prior to the issuance of a building permit. 7. That a 6 -foot strip of landscaping not less than 12 inches in height shall be provided on the Loara Street and Lincoln Avenue frontages of subject pro- perty; that an additional 2% landscaping not less than 3 feet in height shall be provided in the remainder of the parking area; and that said landscaping shall be planted and provided with irrigation facilities prior to final building inspection. 8. That Conditions Nos. 1, 2, 3 and 4 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant.
