64-852RESOLUTIJN NO. 64R-852 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1659. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from TOM H. WEEDA, owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: The East 45 feet of the West 330 feet of the North half of the Northeast quarter of the Northeast quarter of the Southwest quarter of Section 14, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a map thereof recorded in Book 51, page 7, et seq„, Miscellaneous Maps, records of said Orange County; EXCEPTING THEREFROM that portion of said land that is included within a strip of land 75.00 feet in width, lying 33 00 feet Southerly and 42.00 feet Northerly of a line described as follows: Commencing at- the center line intersection of Knott Avenue (formerly Hansen) and Ball Road in the County of Orange, as said intersection is shown in County Surveyor's Transit Book 107, page 19; thence North 0 31 00 West, along said Knott Avenue center line, 1566.92 feet to the true point of beginning i thence from said true point of beginning North 80 44' 00 East, 202.28 feet to the beginning of a curve tangent, concave Northwesterly and having a radius of 1000.00 feet; thence Northeasterly along said curve through a central angle of 34 12' 31, an arc distance of 597.05 feet to a line tangent; thence North 46 31' 29' East, 282.73 feet to the beginning of a curve tangent, concave Southerly and having a radius of 1200.00 feet; thence Northeasterly along said curve through a central angle of 42 50' 16, an arc distance of 897.19 feet to a line tangent; thence North 89 21' 45" East, 330.65 feet to the beginning of a curve tangent, concave Northerly and having a radius of 1600.00 feet; thence Easterly along said curve through a central angle of 20 49' 30" an arc distance of 581.55 feet to a point in the center line of Western Avenue, as said center line is shown on County's Surveyor's Transit Book 114, page 32, said point being distant thereon South 0 33' 45" East, 199.71 feet from the center line of Orange Avenue as shown in said Transit Book 114, page 32, as granted to the Orange County Flood Control District in deed recorded November 29, 1960 in book 5526, page 181, Official Records; ALSO EXCEPTING THEREFROM that portion of the East 45 feet of the West 330 feet of the North half of the Northeast quarter of the Northeast quarter of the AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on October 26, 1964, notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1381, Series 1964-65, recommending that Variance No. 1659 be granted, subject to certain conditions therein set forth; and Southwest quarter of Section 14, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, in the City of Anaheim, as per map recorded in .Book 51, page 7, et seq., Miscellaneous Maps, records of said Orange County; thence Easterly along said curve through a central angle of 20 49' 30" an arc distance of 581.55 feet to a point in the center line of Western Avenue as said center line is shown in County Surveyor's Transit Book 114, page 32, said point being distant thereon South 0 33' 45" East, 199.71 feet from the center line of Orange Avenue as shown in said Transit Book 114, page 32, as granted to the Orange County Flood Control District, in deed recorded November 29, 1960, in Book 5526, page 184, Official Records. -2- WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 24th day of November 19 64 at 7 :00 o'clock P M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a waiver of the one -story height limitation within 150 feet of R -A, Residential-Agricultural, Zoned property and a waiver of the minimum side yard requirement, on the property herein before described, subject to the following conditions: 1. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked `'Exhibits Nos. 1, 2, 3 and 4"; PROVIDED, HOWEVER, that the rear portion of subject property, adjacent to the Orange County Flood Control Channel, shall be graded and landscaped as stipulated by the petitioner. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 4. That this Variance is granted subject to the completion of Reclassification Proceedings No. 64 -65 -35 now pending. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, his heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
