64-820RESOLUTION NO. 64R -820 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 3702 IN RECLASSIFICATION PROCEEDINGS NO. 56- 57 -39. WHEREAS, the City Council did on February 26, 1957 adopt Resolution No. 3702 in Reclassification Proceedings No. 56 -57 -39 finding and determining that the property and area therein described should be changed from R -A, Residential Agricultural Zone to C -3, Heavy Commercial Zone and C -1, Neighborhood- Commercial Zone, as more particularly set forth in said resolution, subject to certain conditions specified therein; and WHEREAS, the owners of subject property through their representatives have requested that the entire parcel of prop- erty described in said resolution be changed to C -1, Neighborhood Commercial Zone since the use for which the C -3 zoning was requested, namely a service station, is now permitted in a C -1 Zone; and WHEREAS, the City Council finds that said request should be granted and that Resolution No. 3702 should be amended to provide that all of the property and area described therein be changed to C -1, Neighborhood Commercial Zone; and WHEREAS, Condition No. 4 of Resolution No. 3702 reads as follows: "4. That the owners of subject property place of record appropriate C -1 and C -3 Deed Restric- tions as required by the City of Anaheim and approved by the City Attorney." AND WHEREAS, the City Council finds that said deed restrictions are not now required and that said condition should be deleted from said resolution and in lieu thereof the follow- ing conditions added to said resolution: 1. That a 25 -foot minimum rear yard building setback shall be maintained where commercial property abuts residential property. 2. That a 35 -foot minimum building setback shall be maintained along Lincoln Avenue. 3. That a 6 -foot minimum building setback shall be maintained on Euclid Avenue and Broadway. 4. That a 6 -foot masonry wall shall be constructed and maintained between the commercial and residential properties. 5. That there shall be no two -story construction within 150 feet of abutting single family residential areas. 6. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Broadway, Euclid Street and Lincoln Avenue for street lighting purposes. -1- 56 -57 -39 AND WHEREAS, the City Council finds that an ordinance has never been adopted changing said zone and completing said reclassification proceedings. NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 3702 in Reclassi- fication Proceedings No. 56 -57 -39 be, and the same is hereby amended as follows: ATTEST: 1. That said resolution be amended to provide that all of the property and area therein described be changed to C -1, NEIGHBORHOOD- COMMERCIAL ZONE. 2. That Condition No. 4 of said resolution be deleted. 3. That the following conditions be added to said reso- lution: DENE M. WILLIAMS a. That a 25 -foot minimum rear yard building setback shall be maintained where commercial property abuts residential property. b. That a 35 -foot minimum building setback shall be maintained along Lincoln Avenue. c. That a 6 -foot minimum building setback shall be maintained on Euclid Avenue and Broadway. d. BE IT FURTHER RESOLVED that in all other respects said Resolution No. 3702 be, and remain in full force and effect.
